    • In terms of "why didn't I make a claim" - well, that has to be understood in the context of the long-standing legal battle and all its permuations with the shark. In essence there was a repo and probable fire sale of the leasehold property - which would have led to me initiating the complaint/ claim v SPF in summer 19. But there was no quick sale. And battle commenced and it ain't done yet 5y later. A potential sale morphed into trying to do a debt deal and then into a full blown battle heading to trial - based on the shark deliberately racking up costs just so the ceo can keep the property for himself.  Along the way they have launched claims in 4 different counties -v- me - trying to get a backdoor B. (Haven't yet succeeded) Simultaneously I got dragged into a contentious forfeiture claim and then into a lease extension debacle - both of which lasted 3y. (I have an association with the freeholders and handled all that legal stuff too) I had some (friend paid for) legal support to begin with.  But mostly I have handled every thing alone.  The sheer weight of all the different cases has been pretty overwhelming. And tedious.  I'm battling an aggressive financial shark that has investors giving them 00s of millions. They've employed teams of expensive lawyers and barristers. And also got juniors doing the boring menial tasks. And, of course, in text book style they've delayed issues on purpose and then sent 000's of docs to read at the 11th hour. Which I not only boringly did read,  but also simultaneously filed for ease of reference later - which has come in very handy in speeding up collating legal bundles and being able to find evidence quickly.  It's also how I found out the damning stuff I could use -v- them.  Bottom line - I haven't really had a moment to breath for 5y. I've had to write a statement recently. And asked a clinic for advice. One of the volunteers asked how I got into this situation.  Which prompted me to say it all started when I got bad advice from a broker. Which kick-started me in to thinking I really should look into making some kind of formal complaint -v- the broker.  Which is where I am now.  Extenuating circumstances as to why I'm complaining so late.  But hopefully still in time ??

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Since 2006 i have been on a DMP and have just partial settled with them all. Most of the creditors defaulted me in 2007, when i started my DMP which i fully understand due to me paying reduced payments. After sending out mt partial settlements via payplan i have obtained my credit report and have discovered that after being on a DMP for nearly 7 years

Lloyds TSB only defaulted me on 28/06/2012

freemans catologue defaulted me on 11/07/2011

Robinsonway defaulted me on 11/06/2008

Cabot defaulted me on 21/12/2008

this means that my credit status has been rubbish for the past 7 years ( which i understand ias i was on DMP) But its also going to be bad for another 6 years because of these late defaults.

Is there anyway of having them removed or the dates altered to when i originally defaulted at the start of my DMP.

All help is greatly appreciated as i am confused as to which letter templates i should use

Have you paid these off now?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Could you please post a suitable redacted copy of these credit file entries something seems very wrong here.

 

I can certainly challenge all the entries if you can give me the original dates.

sorry forgot to add ive just finished with payplan this month as all my creditors took settlements at beginning of this month :-)

Ok what I'm seeing is Freemans default date 11/07/11

Robinsonway '' '' 11/06/08

Cabot '' '' 21/12/08

 

To make any challenge to these would need to know what the status was for each debt Prior to the sale.

 

Do you think/know if these are the Original default dates or have they been changed?

Hi Lisa

 

I had the same issue you need to write to the OC pointing out the fact that the default date is incorrect and you could remind them of the ico guidelines, give them a few weeks to reply and if they don't rectify then you can raise with the ico (as i had to do) do you have copies of the original default notice?

As the previous poster says, write to each creditor pointing out that the default date is wrong and asking them to correct it.

 

If they refuse or don't reply you can then complain to the Information Commissioner's Office.

Those that have reported a default more than 6 months after the cause of action in this case entry into a DMP can be challenged, do you know if these were already defaulted by the creditor, banks usually default quite quickly.

The only default i have a copy of is from lloyds ive never received them in paper form from any of the others, only knew about them after getting my credit report. This is all i kne abiut them as i say ive never received anything written from the other 3 apart from statements.

Cabot wa a capital one credit card & robinsonway was cahoot credit card niether capital one or cahoot gave me any defaults, its only happened when these othe companies have taken over.

I wrote to each company asking them to change the default date to when the account was originally in default when i started the DMP in 2006, i gave them 14 days to respond :-) . So far i have had a reply from Cabot, which is as follows,

'Dear miss #######

YOUR QUERY

further to your recent letter regarding the account.

Please be advised that we have requested information from Capital One concerning clarificationof your default date.

We shall keep you informed of our progress.

If we may be of further assistance do not hesitate to telephone us on the number shown below.'

 

Well ive read enough on these boards to know NOT to telephone and to communicate only by recorded letter. Can anybody advise what i should do next.? How to repsond to this letter as it sounds to me that there just fobbing me off to be honest, how long should i wait to respond?

Hi I received a reply from freemans saying they will reply within 8 weeks and I have also got a reply from Robinson way saying I need to contact cahoot as there saying the default was on the account already when they purchased it in July 2008.

Any advice on how to proceed with the two ?

I think the ICO would insist you wait 8 weeks before complaining to them so if Freemans haven't replied within 8 weeks of the date of your letter just pass that one to the ICO.

 

Over Robinson Way I have a feeling it is up to them to make sure data they hold is accurate so you could write back saying it's up to them to contact Cahoot or ask if that is their final response so you can go to the ICO. It may however be quicker to just write to Cahoot and see what they have to say.

RW are passing the buck really they now own the debt and are resonsible for the cra file entries,but you can try approaching Cahoot about it.

Ive now wrote to cahoot and waiting for a response, the only other one not to reply is lloyds itll be 28 days on the 26th since they signed for the letter :-(

I shall wait til then before i write again to them, how should i aproach them the second time in a letter ( i mean what to write)

Personally I would write a simple 'please reply to my letter of .....' and leave it at that. If they can't be bothered to reply to you then as soon as 8 weeks have passed just go to the ICO.

Hi,

New to this wonderful site, so much great information. Sorry to piggyback you on this one. But I am in a similar situation. I took out a DMP also with payplan, also in 2006. I am now debt free too and I am looking into my credit file in the hope of moving house. I had two defaults on my file still showing (as all of the other creditors defaulted me back in 2006. The only two remaining are black horse (defaulted nov 09) and Opus (was citi credit card) (defaulted feb 10) I started a dispute through equifax re them both as I believed they should have defaulted in dec 2006 (as I had had 6 reduced/late payments by then) as this is when most of my creditors did at number 6 on Equifax report. The GOOD NEWS is black horse replied within 4 days and said they agree and will remove default!!!! this has been done. Opus replied saying they have limited info from citi but they would suggest a later default date then feb 10 as it was settled a few months later!!!!!! My question is are creditors restricted as to when they can default you, ie, is it not best practice to default me within first 6 months of my DMP???? how can they justify giving it 4 years later?

There is a chance you could have some help getting them removed through equifax dispute - so I hope this helps you.

If there is anyone who can give me some help in relation to my citi/opus default, I would be very grateful as this is the only thing holding my family back now and I feel so to blame.
