      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Really annoyed with this. Made private appointment with my wife because shes been ill recently.

 

Turned up for appointment, showed us to waiting room, sat there for 30 mins. I went back to reception - turns out doctor wasn't even there, she'd been on maternity leave for 7 weeks!

 

I'm self-employed consultant so this waste of time has cost me a fair bit of money. If we hadn't showed for appointment hospital would have charged us for a missed appointment.

 

I'm going to complain but surely they should compensate me for any loss? And don't even get me started that theres now a further delay while wife has to find another appointment.

 

(p.s. Anyone looking to use this thread to criticise my choice of using private medicine - don't bother not interested in your opinion)

I agree with you absolutely. The surgery should have advised you that the doctor was not available.

 

I see no reason why you cannot put an invoice in for your time.

 

Had they not even made any arrangements for a different doctor to see your wife ?

That isnt a particularly good example of Private Health Care is it ?

 

IMHO, I would indeed make an official complaint to the Private Clinic and enclose an invoice for your time.

 

The very least they could have done was to have contacted you prior to the appointment date to let you know that the Doctor would not be available.

 

This is the kind of treatment you expect from the NHS who really do not care about the patient. You dont expect it from the Private Sector.

Exactly! Get it all the time from the NHS but I expected better....

I know. The receptionist said doctor X is in room 999 so if you just wait there in the waiting room. We sat there and then realised that it looked like the light was off and after a bit realised it was a bit strange.

 

No idea how long they would have asked us to wait if we hadnt piped up. Probably been waiting there when they wanted to close, still waiting for a doctor who wasn't even there....

did you make the appointment very far in advance they may not have known she was going to be on maternity leave, although I have got to say most private appoinments are within a very short time scale (thats the idea of going private) sound like a major c---- up and i would certainly send in an invoice and see what happens.

In the end I kicked off big time and complained to the hospital. Turns out doctor had been on maternity leave but was due back that day. In the end, seems they didn't bother and didn't even bother informing the hospital.

 

Appointment was only made 3 days previously. I guess as far as the hospital was concerned doctor was going to be there. Apparently, we were only appointment that evening.

 

But, can imagine how unhappy doctor would have been if first day after maternity leave, made the effort to turn up, and then only patient did not show.

 

Invoice on its way methinks...

Yes, absolutely send them an invoice for your time and travel costs.

 

Just recently a chap won a case against a company that continued to phone him even after he asked them not to. He charged them for his wasted time.
