Hi,

 

I am trying to start claiming back PPI of which I think there is a lot.

 

The forums tell me it is best to do it yourself rather than through a PPI claims company.

 

A lot of the ones I am trying to claim were debts which were sold on although a lot were also settled.

 

I am told I can still claim the PPI on all of them.

 

I have written to Blackhorse with SAR letter and am awaiting a response,

however I have found a copy of my agreement from 2007 which has PPI on it.

 

What would be my next step on claiming this amount,

 

also there is a print out with charges on it, can I claim these?

 

I need to know the process of claiming the PPI and where to start!

 

I intend to send SAR letters to all the other companies as well but with this one because I have the agreement I though I might as well get started!

Hi

 

standard procedure would be to complete a fos consumer questionnaire (available from here http://www.financial-ombudsman.org.uk/publications/technical_notes/ppi.html) and ideally a spreadsheet of claim. To do this you will need a copy of the agreement (or the figures from it) and a record of the payments made.

 

If you have this information then have a read of No.1 in my signature as it will tell you how to do the calculations. There are spreadsheets at the end to help you.

 

You would send the completed fos questionnaire to the lender and ideally a print of your spreadsheet and they will have 8 weeks to investigate and give you a final decision.

 

For any accounts that you don't have all the data for then you would SAR the lender. Add a line to the SAR that says it is to include copies of all and any agreements you have ever had with them.

the final part is a brief covering letter,

 

if you cant get all the statements, then say for a loan, you can work things out from the agreement

as long as the loan ran its course.

thanks guys, that is a huge help! I can get started on the one I have the details for, I have already started to SAR the rest!

 

One question though, when you say about the loan running its course, what happens if it didnt because it got assigned to somebody else?

The overriding principle is that you should be put back in the position you would have been in had the PPI not been applied in the first place.

 

The lender will be required to refund you what you paid in PPI and any associated interest plus a further 8% on those payments.

 

There is more detail at No.1 in my signature.

 

Was it sold to a third party or just put out to them for collection?

Hi,

 

It was assigned to a third party whom I am now paying monthly on a 'set aside' Judgment, ie by consent. The amount it says on the agreement is around 2,500.00 and the box is ticked for PPI, it was therefore basically added as a whole amount to the loan so in effect I still have to pay that to the company who took me to Court for the debt. So does this mean I can claim it all back? there were also charges for late payments etc.

If the PPI was mis-sold then the lender must put you back in the position you would have been in without it. (provided it was mis-sold of course)

 

The late payment charges should also be reclaimed as a separate issue.

 

Can you tell us this history of this assignment, who this third party is and the background to the court proceeding?

Hi, its a long background and there is actually a thread on here somewhere about the MEIII court proceedings.

 

Debt was sold to Marlin, who kept pursuing me at an old address,

sent the assignment to my old address etc,

then issued a ccj against me at my old address.

 

First thing I knew I received enforcement proceedings through my local County court,

I therefore applied to dismiss the judgment on the basis it was served at my old address,

 

I have a pending hearing date but they have agreed to set judgment aside by consent with a monthly payment.

 

I CCA'd them and they have the agreement and statement of account which they have sent to me (hence the reason I have this blackhorse agreement from which to claim PPI!).

 

I am going to agree to the 'by consent' with a nominal monthly payment (I have taken previous advice on this from the forums).

 

PS How do I know whether the PPI was misold?

It is just a ticked box on the form and I dont recall being told anything about it.

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

but leave all monetary figures and dates.

hi guys,

i could do with a little help with the calculations on this b horse ppi claim,

 

i havent managed to scan it up

but i think i have nearly managed to work it out!

 

the ppi amount was 2347.14,

which was added to the initial loan amount of 6,500 (interest 3667.60) the interest on it was 1329.86 over 60 months

 

i made only nine payments at an interest.rate of 22.16 which equals 199.44 plus8% which would make 215.44 so is it 2347.14 plus 215.44 that i am claiming?

 

also there are 425.00 of collection activity fees can i claim these back?

 

if so how do i calculate the interest on.that?

do you know in actual money what you paid each week for the ins's?

 

as for the charges

thats easy

 

just put the charge date its reason & it value in the spready

use their APR

 

This fourth spreadsheet is useful in calculating a regulatory based compound interest award for PPI on a Revolving Credit Account. Or for a PENALTY charges Reclaim. Not all statements are required for this sheet because it will work out the compound interest on the PPI payments you do know about. It will not work out the additional 8% interest, to do that you will need spreadsheet three above AND all of your statements.

Hi DX,

 

I have the full statement of all payments and charges.

 

The monthly repayment of PPI was £61.45 of which £22.16 was interest.

 

The PPI was 2357.14 which was added in the beginning to the loan amount.

 

The debt was sold to MEIII

 

whom I now owe the whole amount to (including the PPI figure).

then that'll be £61.45 for every month you paid the full amount

Thanks DX, do I not claim for the full amount plus the interest for the full months that I paid? I was reading the notes in IMS's signature no 1 under single premium PPI Q and A and it seems to suggest that if your debt has been assigned to a DCA?

£61.45 ALREADY includes the int

the spready does the 8% for you

 

just put in £61.45 for EVERY MONTH AND THE DATE that you paid the full amount of the loan for

you get the refund

 

if not it MIGHT come off any debt
