    • Well tbh that’s good news and something she can find out for herself.  She has no intention of peace.  I’m going to ask the thread stays open a little longer.   It seems she had not learned that I am just not the one!!!!  plus I have received new medical info from my vet today.   To remain within agreement, I need to generally ask for advice re:  If new medical information for the pup became apparent now - post agreement signing, that added proof a second genetic disease (tested for in those initial tests in the first case but relayed incorrectly to me then ), does it give me grounds for asking a court to unseal the deed so I can pursue this new info….. if she persists in being a pain ? If generally speaking, a first case was a cardiac issue that can be argued as both genetic and congenital until a genetic test is done and then a second absolute genetic only disease was then discovered, is that deemed a new case or grounds for unsealing? Make sense ?   This disease is only ever genetic!!!!   Rather more damning and indisputable proof of genetic disease breeding with no screening yk prevent.   The vet report showing this was uploaded in the original N1 pack.   Somehow rekeyed as normal when I was called with the results.   A vet visit today shows they were not normal and every symptom he has had reported in all reports uploaded from day one are related to the disease.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

MMF have suddenly in the last few months returned to the threatening and intimidating practices that they used in the past, fighting back against this is absolutely necessary, there is a ''new'' regime'' in their management that either has forgotten what went on before or have not been made aware of it, yes ignore them, then gather information for a complaint to the OFT, I have some already in lace.

Cheers Brig - I'll just ignore them and keep the e mails - are you of the opinion that they would do a doorstep visit for £200?

 

I have to say im surprised e mail is the only communication ive had.

Yes this e-mailing of threatograms is growing, it's even been done by sms I'm told.

They are so unpredictable imo there are seious flaws in their front line management allowing this to taqke place.

Just thought I would add a bit to the argument.

 

I had the same email as above, but they do not have my address, and no phone number.

I had fraud committed in my name by my ex tenant.

5 Payday loans were put into a dormant account I had which my tenant at the time somehow resurrected,

The police dealt with 3 but 2 of them QQ and Uncle *uck would not go through the process and ignored my pleas.

Motormouth contacted me, well after it was all sorted asking for money, that was 2 years ago. After tons of prove it emails back and forth, and even giving them the crime reference number i had, it went quiet. Now they have started again.

 

Thanks to this site I love it as I know how to handle them.

In all honestly Im glad they are back in my life lol,, as after sorting all my mess out last year, I was missing the arguments a bit.

Just an update guys received a further mail tonight - short but sweet this time but im amazed to be receiving stuff at 10pm on a friday night:

Hi all

Further update I've today (indirectly) received a notice of assignment from uncle buck informing me they've sold the debt to motormile. . It went to an address I've not lived at for over 5 years.

 

Would this alter any of the advice you guys gave me above?

 

I've not heard off motormile for over a week now but they were chasing me well in advance of the notice of assignment letter date

OP here with today's update - sent telephone harrassment and doorstep letters - these were signed for on 25th. I've continued to get (lots of) emails and phone calls, and threatening texts. Today's text reads 'unless you call us urgently on (number) an agent will call at your property unannouced. So I'll be getting on to the OFT. Is there anything else I should be doing? Obviously, if they do turn up I know my rights and they'll be told where to go...

Forward their threat texts to the SPAM number of your mobile phone provider, that way they get passed up the chain....

 

This lot are chasing me for a non-debt too, it was repaid in 2008!

 

Let the OFT know that this lot are playing hardball and sending increasingly threatening texts and emails (haven't had them yet but then they don't have my email!.

 

They only have an old address of mine (I moved out 4 1/2 years ago now) and can't link me - so why are they pestering me!

No visit yet, although to be fair I haven't been at home very much. I shall wait with baited breath for the doorbell to ring...

 

The more it goes on the more i think its an empty threat - I've literally just had the same e mail as this morning come through again - word for word just 8 hours apart

 

Starting to smack a bit of desperation now - i'm surprised i havent received any letters though. Purely e mails although they dont have my mob as the alleged "debt" is over 4 years old

Don't delete the email, keep it and add it to a formal complaint to Rob Sands, Compliance Director.

 

This lot phoned again last night and said they were sending a representative round, but they can not link me to the address they have - I've lived here for 4 1/2 years and haven't had a PDL in that time, last time I had one was 2008.

 

Complain to the OFT - I asked for a copy of MMFs complaints procedure two weeks ago, nothing has been received, so I am now complaining to the OFT.

"URGENT message for Mr xxxx. Your agreed repayment plan is now in default. Please contact MMF on 01138876876 immediately quoting reference xxxxxxx"

 

Funny that I've not agreed any repayment plan at all

had a further e mail today - been getting 2/3 a week asking me to contact them for home visit appt but now had this:

 

"Please contact MMF office on 01138876876 to pre-book a Home Visit appointment, otherwise our doorstep agent may have to arrive unannounced. Ref :XXXXXXX"

 

Has anyone actually had a visit from MMF in relation to Uncle Buck debt?

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Had a further e mail today upping the ante:

"This is notice I will arrive unannounced within 4 days. Mike – MMF Agent. Call the office if you wish to make an appointment 0800 9961103. Ref:xxxxx"

 

Just continuing to ignore them as still had no letters through just e mails which all seem to be at random times either late at night or on weekends/bank holidays
