    • While I am waiting for the original solicitor to ring back about the will can I ask. After my dad passed they were informed about this an released a copy of the will to me and my brother, should they have set the trust up then as they were informed of his passing?   Thanks again

The MP, who is one of Rishi Sunak’s trade envoys, is also said to have called his 78-year-old former campaign manager at 3.15am one day in December, claiming he was locked in a flat and needed £5,000 as a matter of “life and death”.   Hes supposed to use funding from Taxpayers and doners for a life of service, not funding a life of drink and debauchery Hope his parliamentary expenses are also investigated.   In fact, perhaps Mr Bates next role in life should be as an independent investigator of Parliamentary expenses?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I wanted to know what the situation was with regards to selling our house whilst under an IVA agreement. Is this allowed. I realsie any monies would go direct to my IVA but do they allow you to seel the house in the first place?

Hello there.

 

You should be able to sell the property, you'll need to let your IP know what you're planning to do though. As you've already mentioned you may have an obligation to pay them some/all of the equity. Do re-read the property-related clauses within your IVA contract.

Thanks...and what if the property plus all the Solicitors and estae agents fees don't cover my mortgage. This is my next concern. I guess the answer is I can't sell it...I have no access to any other money and i doubt my mortgage compnay would let me walk away with a debt to them

Does anyone know the answer to my question. I am currently going through an IVA Failure. So within the next 6 months I will be kicked up as I have failed to make any payments for 2 years. (I wont go into why as too long a story).My question is, once failed, would I be able to apply to a different compnay for IVA a second time. I will be in a different position by then so shouls be able ot make soem payments. (Once again this may sound odd but take too long to explain why.)I have asked the IVA to defer this decision as in the next few months things will be different but they are telling me it is now too late

Is there a reason why this one has failed, This This has failed because my other half is an alcoholic and loads of money spent on this I told IVA this but not thier problem. Also, cost of living gone up. Not once would they look at reviewing my figures over 3 years though. and are you sure an IVA is the right option? How much do you owe? Debt is £35k. No where else to go other than IVA. Since then PPI paid in £4.5k and I paid in one year which was about £4.5k Have you any assets? Mortgage on house. Just had it vauled and about £10k in it if goes for asking price. Are you in mortgaged accomodation? My partner and I are now splitting and therefore I feel I would have a little more disposable income to pay something towards a new IVA or existing IVA if they were to stop the failure. But nowhere near the £384 they want per month. I have worked out I could pay about £100 if everything goes according to plan.

Hi, I need to setup a new bank account as myself and partner seperating. We have an IVA. Existing Santander will not provide asecond bank account (So that my partner and I can go our seperate ways).

 

Does anyone know which banks offer a basic account with an atm card and no charges, if you are on an IVA?

 

I think I looked at thinkbanking but as they charge a monthly fee this is not desirable.

Hello Jane, I know how u feel, my ex was a violent alcoholic, u are doing the right thing in splitting up, stay strong. U can apply for another iva, just make sure u are only paying your debts and not his as well. Good luck

Thanks for your reply. He has now gone and I am told the IVA will officlaly fail sometime in August. Most fo the debts are in my name so I see a long way ahead trying to clear it all up. Despiute the fact that these are joint debts but he will never agree to contributing. He is now living with parents and now the lowest he can be. I am just gald to be rid. I will update this when I know more about the IVA and what I can do.:-)
