Hi I'm trying to set up a repayment plan with good old Uncle Buck I owe them £600 and have offered to repay them back at £70 per month providing that they freeze interest and further charges.

UB have sent me an email from "Plandeal collections" requesteing me to fill in a CFS / personal budget form that is 14 pages long with a lot of intrusive questions.

They have also asked me to send a copy of my Bank Statement and Payslips (which I have no intention of supplying to them!).

 

I want to negotiate a repayment plan with them, I think that my pro-rata proposal is fair, however I dont want to be made to"jump through hoops" with excessive form filling or supply them with personal /financial data.

 

Any advice on how I should respond, also has anyone else had similar dealings with PLANDEAL COLLECTIONS ( I presume this is UB's in house collection team?)

Ignore that silly I&E form. They have no right to it at all.

If it'll help with getting the deal done I still hold that it doesn't make a difference...

 

The same as never talk to them on the phone.

 

Some of the payday loans i had were sorted out with one phone call.

CAG's advice is not to phone them and NOT to send documents that they have no rights to. However, at the end of the day it is up to the person who is being chased, exactly what they do. Just remember that they have no reason or need to see any details like that. Especially when they are a very low priority creditor. The only companies with any need to see things like that are mortgage companies/secured loans or courts.

 

If you REALLY want to send them a I&E form. Ignore their silly one, and send in a simplified budget summary and sign it as a declaration of fact. If that is good enough for court, as well as some high priority lenders, it is MORE than enough for a desperate PDL.

Requesting that the debtor fills in a 14 page I&E form is NOT acceptable jamie. If it was a simplified one, then yes, i would be in agreement, but a 14 PAGE form? They are taking the mickey.

I am in the EXACT same situation. I owe about £450. I have told them i can pay £10 per month for 2 months, then can up it to £30 per month after that. They wont accept any sort of repayment plan without me sending in the same documents as they have asked from you. I am happy to send in my own I&E form, but certainly will not be sending them a 14 page version or my bank statements. no way. Both Uncle Buck and then PlanDeal have taken the same stance and say they will not accept any plan without these documents.

 

I have informed them i will continue to pay them as advised regardless of their acceptance or not. But i worry what they will do next. Plandeal are in house collections for UB, but what will happen next? Will they go to court or send to external collectors? Anyone got any experience of dealing with UB then Plandeal, and what they they do next?

Dont worry about what they will do next. Even if they try to take you to court, you can show the court that you tried to get a repayment plan in place, you started repayments as you told them, and you kept them up. The PDL would be foolish to continue if you submitted that as a defence.

 

I should mention that taking people to court is rare. They love to threaten and harass to extort as much from you as possible. Since they issue these threats, they wont want a court to see their shady business practices. In fact, thats why very few PDL's ever do take someone to court. They seem to only take those where they think they can get a judgement by default. If a defence is filed with the court, they back out pretty damn fast.

Just to share an update of my progress, I took your advice and e-mailed UB a copy of my own I/E budget plan and propsosed repayment plan - I didn't send copies of Bank Statements or Pay-slips.

 

UB have now replied and have agreed to my repayment plan, so its a good result for me as I thought that getting a repayment plan was going to take considerable time with UB!

Just make sure that YOU stick to the plan. Let them mess up and then you can take them to the cleaners. If you mess up and dont have a very good reason, they will come down on you again.
