    • Remember that this hearing is not the court battle between you and VCS to decide if you owe them money for their ticket or not.  That will come much later if you win this round and want to keep fighting them.   The hearing is simply to set aside judgement given you had no chance to defend your claim before.  The judge will want to know (a) if you acted promptly once you found out about the CCJ, (b) why you didn't defend before and (c) if you have a chance of defending your claim.    That said, you're right to want to understand the legal arguments and it's always better to prepare too much rather than too little.  So I'll try to answer some of your points.   1.  You were not the driver of the vehicle.  You were nowhere near the airport.  So why the hell are VCS suing you rather than the driver?  There is part of a law, Schedule 4 of the Protection of Freedoms Act 2012, which does allow liability to be passed from the driver to the keeper but your case is that VCS have not respected the norms of this law.   2.  VCS may be employed by the landowner or they may not, you simply don't know.  That's for them to prove.  They have often been tripped up by showing out of date or unsigned contracts.  in reality their contracts are almost never with the landowner but with an intermediary management committee and of very dubious legality.   3.  VCS have lost on bye-laws many times.  Go and look up the bye-laws for Bristol airport.  They can't substitute themselves for the police or the magistrates.  If you saw someone you recognised vandalising road signs in the street where you lived you wouldn't start issuing them with fines, you would have no authority to do so.  You would call the police and they would be prosecuted.  Same thing.     Work calls now.  I'll deal with (4) and (5) later tonight unless someone else explains before.
    • Having never been to court I am quite apprehensive and need to understand what I am saying Can you give any indication how it will work - what I will need to say etc. Also I don't understand everything as I was helped to write my defence ie.   1.  Schedule 4 of the Protection of Freedoms Act 2012 2.  Locus Stands - the claimant is not the landowner - can I have the arguments why not being the landowner means he has know authority to issue a ticket - surely he is employed by the landowner? 3.  Bristol Airport is covered by bye-laws, a traffic violation should be prosecuted in the Magistrates Court, a private company can't replace the police or magistrates - can you elaborate - what bye-law - any previous arguments on this point? 4.  How do we know the claimant has not obtained planning permission for their signs which is a criminal offence (is it, why?) and makes it impossible to have formed a contract with the driver - what does this mean exactly? 5.  How is the claimant claiming the debt, legal costs and an extra invented sum as an attempt at double recovery which invalidates the whole claim?  How does it invalidate the claim?   Thanks

    • Hi,   Just after a second opinion hoping anyone here can help with.   I was involved in a no fault incident where another driver sped by and hit my driver side wing mirror while i was parked and completely broke it off. The driver did not stop and just continued to speed off. I managed to get the other cars reg just in time.   I made a claim to my insurance (Admiral) and they told me the other driver is also with them. This was 2 weeks ago and they have been trying to get hold of the other driver to establish liability but they have not been responding.   Admiral told me i can use the excess on my policy to pay to repair my car and also for legal expenses and then claim it back once they have reached a conclusion as to liability - or alternatively they can return my car to my home un-repaired again until liability is established. I asked them how long this could take and they didn't give me any timescale.   Looking at the terms from Admiral Law they said this case can take up to a maximum of 18 months till i can get my money back.   I'm not too happy about this prospect and i've lost hope that the other party will ever respond or admit liability.   I'm starting to feel i'm not getting the service i paid for from Admiral. I'd rather not have to pay anything and wait for over a year to get my money back.   I reported this to the police who haven't been too helpful either.   I guess my question is is this standard procedure for every insurance company? Am i just going to have to accept it and pay for repair and go through the enormous headache of making a legal case on the 3rd party or should Admiral really be stepping in to cover all this which is what i paid them for?

With the sad passing of Martin, I thought it would be nice to recount a very happy memory of this lovely man.

Not long after I discovered CAG in 2006 there was talk of a CAG meet. The venue was a camp site in Gloucestershire. When I arrived the last thing I expected was to find a disco (Yes, in a tent in a field). Behind this was one of the most eccentric but wonderful men, Martin Kay - Martin3030. What followed was a great party with huge amounts of alcohol consumed. After the event a DVD was produced of it, compete with introduction by Martin.

After this I joined the site team and got to work closely with Martin and became friends with him. I have had occasional contact with him since I retired from this site and I will miss this.

I thought about distributing it - but suddenly I thought that there maybe other people on it who maybe wouldn't want it to be generally circulated.

 

It's a bit of a tricky situation. I'm not quite sure what to do.

 

Certainly, the family will get it - no one could object to that - but after that, frankly I'm not sure what is the best thing to do.

Hi all my condolences to the family and friends of Martin. I did not have the pleasure of talking with Martin, I am sure he will be sadly missed, in my opinion any loss to the CAG is a sad loss.It sounds like he was a great mind!

It is with sadness that I discovered only a few days ago through this site that Martin had passed away. I had been sending texts to his number for a couple of months as I had in the last few years had taken to contacting him directly . He helped me on so many occasions and would have liked to show my respects. Such a loss on so many levels my unsung hero , his tenacity , intelligence and generosity with his time was greatly appreciated . RIP Martin

I discovered this sad news the other day.

 

My sincere, belated condolences to his family, his many friends, everyone who worked with him on CAG and everyone who benefitted from his knowledge and humour here on CAG and in life elsewhere.

 

An amazing person and a tragic loss. Very hard to comprehend when someone leaves so early in life, but he left a huge imprint and will be fondly remembered.

 

Requiescat in Pace.

Any advice given by me is based solely on my experience in claiming, my experience in CAG or my opinion. I have no legal background. I want to encourage others to reclaim what is theirs.

 

Got a DCA breaking OFT guidance. Complain to the OFT about the DCA. Help put an end to these practices-
