      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I found an old HFC Loan Agreement from 1986 not sure if anyone has claimed back that far.

Will be sending the doc's off today will keep you informed.

It's Ironic that at the top of the agreement it says TRUST would you trust them:roll:

If it is of any boost to you, HFC coughed mine up back to 1988/89.

They are going to cough up for my other claim 1989 only offered 3k, it should be 6k so rejected it, just waiting for their reply.

Yep its an old doc missed it the first time searching the loft:shock:

UPDATE

 

 

Telephoned HFC today to see what was happening with my claim,.

You’re not going to believe this but they say they haven’t received my claim.

 

I told them I had sent it recorded on 5th February. They have told me they would sendout a claims for out to me and the 8 weeks turnaround time scale started fromtoday.

Oh that old chestnut! When I sent my SAR request we were backwards and forwards for ages. We haven't received your proof of ID, we haven't received your cheque. Even though it was all sent together they swore blind they didn't have it. One department sent back all the info and the cheque saying they didn't have proof of ID and another sent paperwork and proof of ID saying they couldn't do anything without a cheque! Total idiots. I think the only reason they coughed the old agreements was when they realised I wasn't going away. They even gave me back my £10! Let's see how they feel when my claims turn up!

I keep getting someone called Dexter,

he keeps telling me they only go back 6 years, he must say it that many times a day. I think he just presses a button, then if you ask for a supervisor I always seem to get Anita, then we have to go through all the questions over and over again. They seem to be nice people but think they have been told what to say.

I for one will not go away :wink:

They are insisting I send in my bank statements to show that the loan payments were actually made, despite sending a SAR saying they had no records, and me sending through a copy of the loan agreement etc etc so many times. They have offered me 1 months premiums plus interest to date as I only sent them one bank statement (I did that to prove I did have records), and now think I should take mickey and send them very second one for 48 months, and then the rest when they have recalculated just to keep them busy. The said I cannot take it to FOS but instead to the FSCS or something. The loan was a loan rather than a finance leasing agreement so I think they are wrong on that score.

They have asked for my bank statements I do have most of them. I keep telling them if I hadn't paid it off they would have been chasing me for thedebt.

 

I'm just about to go to FOS with my other claim with them, think they justtry to make it as difficult as they can so you give up. I will not be givingup, I have waited this long so another years not going to bother me.
