"Relief from sanctions 3.9 (1) On an application for relief from any sanction imposed for a failure to comply with any rule, practice direction or court order, the court will consider all the circumstances of the case, so as to enable it to deal justly with the application, including the need – (a) for litigation to be conducted efficiently and at proportionate cost; and (b) to enforce compliance with rules, practice directions and orders. (2) An application for relief must be supported by evidence." Do I need to a seperate application for relief? Or include something specific here in the WS? -

current in arrears , paid them over forty thousand pounds they want another 60000 maybe more for a loan of 32.000 , they said that they gave me a cheque for nearly five thousand from the loan I told them when they let me have the paper work eventually I never received heir cheque , showed them bank statements from that year , they said I could have cashed it in a money shop , also they paid the loan I had all the money it was a five year loan taken out less than a year . refused to take off PPI as well this would bring the loan to under 25.000 -

@lookin4infothanks it seems like there are a lot of points to chose from your post for WS. Is it possible if can post a draft so i can copy points and include in my ws i will attach the photographs as exhibit and also attach the proof of purchase from the McDonald's as well. PS shall i include defense as exhibit with Witness statement? -

Yes! then sit back and relax for a month awaiting their reply. That paperwork (assuming that's everything they sent as you say) is not enforceable, it's missing key elements that would prove authenticity and is likely a cobbled together reconstruction from stuff they found in the trash hoping you except it and pay them.. this should be unlawful, but hey that's what they do! The reason dx was asking for unredacted is so we are able to tailor the advice more effectively, that's all.
