    • Dear Sir/Madam, TFL case number: **** I would like to thank TFL for providing me the opportunity to explain my behaviour. I realised the stupidity of what I have done and wish to seek a resolution to this matter. I have no valid excuse for this action and I am extremely sorry and deeply regret my action. I hope you will accept my sincere apologies. Nothing can justify my action. I am aware that TFL are only able to operate if everyone pays their fare correctly and I feel so guilty about attempting to breach public trust. This has caused me sleepness nights and raised my anxieties. I have history of anxiety. This has been a hard lesson learnt. I have never been in trouble with the law in the past and I ensure that I won’t be in the future. I am and will be using my oyster card (PAYG). I would like to humbly appeal to TFL to allow me to settle this matter out of court and avoid going to prosecution given the adverse consequences it can have on me and my family. I am very concerned that prosecution for the first time and I would like to make restitution for my action. Having a criminal offense on my record will have detrimental consequences on me. I have always been a law abiding person and have no previous offences. I would really appreciate if I can be given the opportunity to pay for any unpaid fares plus any charges and/or administrative cost which have been incurred by TFL due to this incident. I am sincerely remorseful and ashamed of myself, and I fully appreciate the severity and stupidity of my transgressions. Again, I would like to offer my sincerest apologies. Yours Faithfully, My Name
    • the date is 19/04/24, so i have until 29/4/24 to reply? Yes, i will send my draft of my begging letter   
    • use the webform if it allows you to attach your evidential documents then do so but do that later depending upon who your bank is.... - but i suspect you will be referred to Mastercard. who is your bank? dx    
    • If i did it through the bank, they seem to have an online form. I wondered if this is the best way or to do a letter, add supporting documents and send them through the post, recorded delivery  ?
    • the process for attaining a charging order is the same no matter what it results in. interim first then latter they can go for a full charging order. at ICO stage its recorded the same on your deeds until a full CO is applied for and granted. however, as in your case, it resulted in simply a restriction k which cannot be converted into a full charging order so the entry remains stating ICO. smart cookies on your side IMHO now ...hope you succeed. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I haven't spoken to Martin properly in a long time but once we were quite close. I am very sad to hear of his passing, far too early. I agree with the sentiments expressed by Bankfodder - he was an intelligent man who up until CAG hadn't really found an outlet for his knowledge and passion. I am sure he will be missed by many many people.

Just in total shock, Martin was the reason I joined the site team, I had troubles with credit card debt and through his and another site team members advice was able to get myself sorted, I vowed to help anybody I could and to be asked by Martin to join was a true honour which I hope I lived up to in my short stint.

 

Unfortunately I've not really been in touch since leaving the site team and thats to my regret and my loss as his humour and wit will be sorely missed, I'll fondly remember the site team meetings especially the social part.

 

My sympathies to his wife and family & the CAG site team.

It is always sad to hear the loss of somebody. This is no exception. I never had much to do with Martin during my time here, but he always seemed to be there for anybody who needed help. One can see from the number of posts that he made how helpful he was.

 

My condolences got out to his nearest and dearest.

Martin, I've left posting this until I thought I could get it right.

 

You gave your life to CAG as much as you could and would have done anything you could to help anyone here. You achieved a huge amount and were kind, wise and just.

 

When I was a site team newbie, you had time for me. You never judged or made people feel bad.

 

The forum will not be the same without you.

Martin when I had doubts about being here because of my background you told me about yourself and how you made your life work it reminded me that I was privilaged, and made me more determined to help others if I can!!!

I guess we'll never know the true number of people Martin helped - it must run into thousands. So many have so much to thank him for - his commitment to helping those who didn't know where to start to help themselves was incredible.

 

God Bless you Martin - I will miss your friendship and support.

Have just received the email and this is such sad news for all of us who have been helped by him, or helped by someone who was helped by him.

 

That is just too young to go.

 

He will be sorely missed - he is already. And we did not have the time to let him know how valuable his knowledge, support and helpful advice has been over the years to hundreds of thousands, possibly millions of people out there.

 

As said, may he and Rooster be having a good time together.

I am so shocked by this, Martin as been a fantastic help to me he was helping my sister in 2010 just before she died she was so overwhlemed at his kindness, my thoughts go out to his family at this very sad time nice to see his face on here just wish it was not in these circumstances, he will be very sadly missed

I have signed back in to CAG to say RIP Martin. You will be missed by so many and you were truly an inspiration to many CAG members who found themselves in need of expert help. You gave them that help and you are I am sure applauded by the CAG team and all those you helped with sound advice.

I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

Wow, what a shock :( I didn't meet Martin in person, but we had many conversations here on CAG and also exchanged private messages. A very knowledgeable and helpful guy, his advice was always spot on, and he was very supportive. After a fairly long absence from CAG I had to return just to show my respect for Martin and offer condolences to his family, friends and all who knew him. R.I.P Martin3030

I was so sad to read my emails this morning. I haven't posted for a while because Family life took over etc.

When I first joined this forum I was at my wits end, not knowing which way to turn and Martin and you regs, helped me no end in so many ways and I will be for ever grateful to Martin and this forum.

Please convey my good wishes to Martin's dear Family at this sad time. (((X)))

I'm a bit of a lapsed member of CAG;

I thankfully needed no more help from the kind members here, and I also felt that my own job, and any help I could give back here was done, as my area of specialisation was business bank charges (starting the thread "claiming on a business account, lets join forces? ...if anyone remembers), and once that door became closed I had a lot less to contribute.......plus lots of other personal things in life just sort of took over my time.

 

There was never any chance of Martin ever becoming a lapsed member though !

His passion, his drive and his quest to see right done were exceptional.

Likewise his ability to research, comprehend, seek out, and interpret for others was exceptional..... as was his kindness and eagerness to help others.

I only ever spoke to Martin on the phone, but after doing so several times into the early hours of the morning, I did feel a great affinity with him, and as if I had known him a long time, such was his welcoming and friendly nature.

 

The loss of Martin is the loss of a truly exceptional person; a great loss to this site and the cause for justice, but more importantly the loss of a kind, gentle and selfless person for all his family and friends.

 

We all say RIP Martin Kay... but right now, he's probably already going through St Peters bank statements looking for errors !!
