      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

I have been with BH for over 5 years, and last year i went on sick!! and

 

i have tryed my best to keep up with paying BH but from xmas till now i have not paid them as i just dont have the money to pay!

 

i have about 5 items and 3 of them items i have paid about 2 years off them so i only have a year to pay!

 

i got a call today to say they will have to pick some of the items up!!

 

but i said no i dont think so! as i have paid so much of them...

 

dont get me wrong i want to pay!

 

 

But im not sure how to go about this and thats why im here,

what should i do next!!

 

will BH take part payment on top of my weekly payment?

well they certainly CANNOT demand or take items back UNLESS

you give them too them, you have paid more than 1/3rd

 

so DONT put up with ANY bull about that

 

and the 'we'll get the police to do it rubbish too!

 

havev you their two USELESS insruances?

 

if so

 

get reclaiming

 

you DONT need them

 

they are NOT compulsory

regardless to 'their' rules.

 

as for the payments.

 

pay what you can when you fet.

 

you might find the reclaims KILL the balance anyhow.

I only have 1 of the ins! now as i got the OSC taken of just before xmas

 

should i just go into them and pay what i can each week or will they not take the payment??

at the end of the day they can wave their arms around all they like

 

what you have not got you cannot pay

 

if you've been with them that long

 

its a bout time you dumped them!!

 

you've prob paid 3-5 times the market value of items anyhow!!

 

why not pay them by your internet bankingsite?

 

did you get that cancelled OSC back?

 

should have

 

why have you the other ins?

It makes me sick when i think about the items i have had of BH over the years and how much i have paid!!

 

as to the OSC no i did not get it back! can i ? and could i get it back of of items i have paid for!! as i have 3 or 4 items that have been paid for over the years!! + the 3 iteams i have paid 2 years off

 

How do i go about geting the OSC back!!

I have just looked over 4 agreements 2 of them have been paid off and 2 i have still, over all i have paid £2,565 in OSC omg can i get this back??

you paid OSC every week

 

take the DATE of 'a' payment [typically the very first one you ever paid]

 

click your mouse in B20 - enter it in the format of DD/MM/YYY then hit tab key

 

you are now in the description bit - type OSC hit tab key

 

you are now in the amount of charge - enter it first one done!!

 

now click your mouse in B21

I have been on here allday looking into this, and reading posts! i will be going down the road i was miss-sold it!

 

as at the time of takeing out my 1st item with BH i was told i had to have the OSC or i could not get the item!

 

just 5 mins ago i had BH nocking at my door, wants me to do a RW i dont think so....
