Are you managing to work . You should go and see your gp and they will be able to help you sort out anxieties. You need some help,

im going tomoz..my husband is sorting the iva out as well....he is scared they will section me when i go as ive lost so much weight and look awful but i cant help it..how long did yrs go on from first phone call....were they horrid to you on phone....my daughter is so clingy its my fault......in work its like im in a dream and to make it worse i work in a shop.....you must be very strong im not.....this will stay with me for the rest of my life..

I don't know why you think £3000 is applicable. That is only for knowingly providing false information. For delaying reporting a change its only max £300

 

"If you don't report a change on time, you could get paid too much in tax credits. If this happens, the Tax Credit Office may charge you a penalty of up to £300"

 

but if they go back as they have said to 2011 -2012 with no evidence of husbands lodges they will fine me 3000 xx sorry scotsgal but looking at everything xxxx foolmum

Try not to worry too much - their aim seems to get money back rather than prosecuting people.

 

I hate to be the bearer of bad news but the fact that you can't prove your husband's living arrangements from 2011-2012 may result in them fining you £3000, £300 is when you delay reporting a late change of circs but in these circumstances they will class it as a fraudulent claim (it sounds bad but is just their term for it).

 

You should be allowed to repay the overpayment over 10 years without the need for an income/expenditure review - the fine will be different but explain that you have an IVA & they may allow you to pay this in instalments aswell.

 

There seem to be a lot of people in the same situation, you certainly aren't the only one so there is no reason to expect them to come down hard on you any more than they have anyone else.

 

Take care & hope you hear from them soon with some sort of resolution.

omg my worst fear....how do i pay both....

.it just gets worse....i have given all info and will be sending all house bills in.... i dont kknow how im going to get through this

Whatshouldido-, cheers, it has taken me days to try and help calm foolmum down, and with your post, you have probably undone so much. Your info isn't even 100% certain. What you have told Foolmum isn't what is happening with undisclosed partner cases. I appreciate you thought you might have being helpful but in this case, you weren't

Scotgal68 - sorry but this is what they are doing in undisclosed partner cases, you only have to read the internet to see that (& yes I have an overpayment & had a fine for an undisclosed partner although I had actually disclosed my info to hmrc). Foolmum does need to calm down but no-one can do that for her & leading her believe that she will only be fined £300 isn't going to help if a £3000 bill lands on the doormat.

well i have been to the docs and c a b . have an appointment for 5 feb with the woman who deals with these cases..just preparing for the big fine. also been to the docs. just a waiting game..i have done wrong so they will prob put a 3000 fine on me...god help me...xx

The thing to do here is not panic because you've had a different point of view here. I'm pleased you're going to see a CAB specialist, they have plenty of experience of this?

 

I'm not sure where this £3000 comes from. WhatshouldIdo, would you be able to link us to a source for what you're saying please?

Foolmum,,CALM DOWN HUNNY,,SERIOUSLY..They are NOT going to hang you,take your child away,cart you off anywhere or any of the scenarios you are imagining in your panicked state...IT'S MONEY..and they won't be able to take what you physically do NOT have. They are more interested in a sensible payment plan than they are in making your life hell,and NOONE can tell you what they will or won't fine you....I've been there,,done that,,and it took longer for me to get my sanity back than it did to sort the repayment schedule out. Honestly hun,,stop reading other threads,,not one is relevant to your individual case. Now,,get a cup of tea,,and try to relax,,,it's not going to ruin your life unless you let it and you don't want to do that now do you??

The compliance team are not ogres. They know tax credits are important to families. I was in the same situation last year when I had a compliance check. My wife had done a months worth of work and I didn't think it was important to tell them for such a short period. My child tax credits were reduced, with the reduction amount used to repay them. Luckily for me, the repayment is due to complete at the end of the tax year - not too far away, then my payments will go back to the normal amount.

 

I can't deny it's been a struggle, but the thing to remember is that there is always help available. My fellow contributors to your thread is a sign of this.

 

You sound very stressed, with is understandable. You need to calm yourself down. Speak to your GP. They understand these things happen and they can often help - just talking to someone will help to get a load of your chest, and don't forget that it's confidential.

 

Please, don't suffer in silence. Let us help you to help yourself (god that's corny!)

the docs were brill..she thinks this has been my braking point after years of probs...9 ivf trys.... nephew 17 found dead of sds

..mum dropped down dead in front of me six months later and found my dad dead.money worries and separation...no excuse what i did but why im struggling to deal with the situation....so i think its time to sort myself out and deal with this. im scared but ive been scared of life for a long time...so thankyou all for yr kind advice xxx lets just baby walk day by day hay...the docs has helped me understand why at least i feel like i do xxx

hi am so glad you went to the docs , must have been a big help.

You must start trying to relax, and get this thing about being fined out of your head, i had no proof about living arrangements, only a hand written letter from landlord and that was not good enough, they looked back 2 years on me and i was not fined so i doubt if you will,as someone said earlier everyones case is different.

Once you have your claim sorted and know what you have to repay, you will feel alot better.

thankyou....i think in some ways this has helped me face up to many things..hubby has letters stating he lodged for certain periods....but i know this wont prove but what else can i do if i fight it could make things worse..... so just will have to take it...but at no time do they mention you credit linked....must note nothing taken out to link us since the split.cxx

2011 - 2012 so two yrs ..... lets just hope hey.

its going to be a hard couple of months but cab said they have had lots of these in the last couple of months.........how r u now folle did anti depresants help...the docs have put me on them and said they will write on my behalf...... foolmum

that is only one tax year, so you might not have much of an overpayment,.

i was given anti depressants, as well as other drugs for panic attacks and something to knock me out at night, i had a huge breakdown, but to be honest it is not worth it, after a few months i just stopped taking them, it is year since all this happened and have just got on with my life, not worth going back, you will get through this and come out the other end, from what you have said you have been through so much, so you are a strong person, have a daughter like myself and she was a big help to me.

You sound as though you have a good gp, they will give you lots of support.

hi folle it is two cos they work in provisional payment so its this yrs as well cos hubby came home august...

yes my gp has been fab ....i have managed some toast today so thats better but work is hard as noone knows xxxx
