Hi All,T

his is my first time posting,

 

a friend uses the site regularly.

 

Checking my Experian report today i have a defaulted balance on an account of £6,866

 

This is from an old HSBC account i used to have, and i have never cleared this off.

 

The owner of the debt is MKDP LLP.

 

Started: 31/08/2000

Default date: 12/12/2007

 

Im sure you will all whince at this, but

 

i stupidly made a call to MKDP LLP today saying that i cleared this years ago and have no idea why this is still on my record.

 

I did confirm my current address which they already had. (sorry)

 

I am now into the last 11 months of the debt before this is cleared,

 

the questions i need answering are below:

 

Am i best to sit tight and wait for their court order before moving forward again?

 

What can the debtor do now that i have made contact?

 

If i were to make them an offer on the debt how much should i offer?

 

If i do agree a lesser fee with them will this satisfy the debt on my report so i can start to build my credit back up or will i still need to cover the difference?

 

I am absolutely kicking myself for calling them, im not sure why i did it,

 

But if anyone else has had similar experiences it would be great to know what options (if any) i have.Cheers

well i'd guess at least 2-3 months to SB then.

 

it will vanish off your cra file on the defaults 6th birthday regardles to if you pay it or not.

(i am new to all of this)

 

in theory i should just sit tight, and hope that nothing comes of this?

 

ignore the letters and calls etc?

 

and then wait until it is cleared from my report on the 12/12/2013?

i do hope the fact i called them will not change any dates etc,

 

im sure they will try to harrass me as much as possible over the next 12 months

 

.you did mention 2-3 months for SB - however it would be due on the 12/12/2013,

 

im guessing it wont be sorted any earlier?

a default usually take 2-3 months to be placed after the cause of action

so last payment

 

SB is from last written ack or transaction.

phone calls do not count

Hi All,

 

I posted on here many months ago about an old debt which has been sitting in my credit file.

 

Now,

although I do not want to be one of those people who 'runs away' from debt,

as I was in the final year of the default I took the decision not to acknowledge the debt and wait for it to 'fall off' my credit report.

 

 

below are the details of the debt:

 

 

HSBC

£5,500

Started: 31/08/2000

Default Date: 12/12/2007

 

 

I have not contacted or acknowledged the debt since the default date.

 

As such, I have a few questions, which I am sure have been covered on other posts, but I just wanted to be sure.

 

Today is 12/12/2013, does that mean that this should now drop off my credit report?

 

In your experience how long after the 6 years does it take to drop off the report?

 

Does this have an immediate 'positive' reaction on my credit file or will it still be referenced by creditors? If so how long?

 

I have read about the statue barred side of things.

 

Does this mean if I have a call / letter / visit from a collection agency that I just mention that the debt is now over 6 years old and they are not able to chase any longer?

 

Apologies for many questions, but I am really hoping that after today I can start moving on with repairing my credit report.

 

Also in that area, if there is any advice from experience that may be useful in this situation that would be superb.

ideally i'd wait until the new year

 

then if anything does happen

 

send the SB letter.

 

obv nevre ever converse at your door or the phone about debt.

 

DCA's or doorsteppers ARE NOT BAILIFFS

 

and

 

HAVE NO SUCH LEGAL POWERS

I have just joined the group and I am having a similar issue. I took out a credit card back I. 2002, my marriage broke down and he took bankruptcy and I struggled on with CCCS through a dmp to try and service all of my debts. By 2004 my name in the financial world was mud as everything had defaulted. Now here we are in 2014 and as of April my credit file was clean and fresh and I was so happy. Last week I received a letter from MKDP asking if I knew someone by my name who lived at my pervious address- I moved 3 years ago and let everyone know my new address either personally or via Step Change( previously CCCS).

Further my previous address is owned by a family member who passes all post to me that does still arrive at the old address.

I had no idea what they could be talking about as as far as I was aware all of my creditors knew where I was and I had never heard from this company or any other about my not paying off a debt...

When the letter arrived after my initial panic I googled the company and by all accounts thought I should best ignore as it may be a fishing trip...

Well I had a look at my Experian file last night and low and behold I have a default. A card that was taken in in 2002 and apparently defaulted in 2012. Now I have no idea how a card could wait a whole 8 years to be defaulted. The date seems to be the same as when I stopped my arrangement with CCCS as I would rather all the money I pay go towards my debt but that is another mater. As far as I was aware every single debt I I cured in the early 2000's defaulted. A credit card company wouldn't accept payments via a dmp on a debt that wasn't in default would they?

 

What do I do now? I am heart broken and distraught. I finally thought the worst was behind me and now it seems I have another 5 years. How can they do this, and more importantly how can

I stop them! I am so totally confused.
