Just had a phone call from them - never heard of them. They say they have been writing to us - er no. Anyone any idea who they mainly deal with?

Debt Collcetion Agency, any debts, Credit Cards, Store Cards, catalogue accounts. bank accounts, overdrafts. often very old debts.

 

Check your credit reference files asap.

I have - but none of the companies we are dealing with have contacted us with this name. Certainly Robinson Way have never contacted us. I have no idea what this is about - I expect once they bother to write to us we shall cca them is appropriate.

letter from Robinson Way - no account number nothing - absolutley NO indication as to what this is about.

 

The letter reads as follows:

 

Dear Mr..........................,

1) debt to Barclaycard

2)CCA'd them

3) letter sent from Barclaycard 27/09/12 stating debt unenforceable

4) Robinson Way contact us saying the debt has been passed to them - 11/02/13

5) we KNOW it is unenforceable

6) what do i do now?

Hi, The debt is unforceable in court, the situation is that the debt still exists and remains payable and collectable by any means short of court action.

So RW can jump up and down shout about ''moraly you'' should pay the debt etc.

 

So send a copy of the BC letter to RW, saying that you will not tolerate constant contact by any means, and you will not resond to further contact, ie This is My Final Response.

That's what I thought - thank you.

 

And as for morals - they are fine ones to talk after their exorbitant rates of interest, bank charges, misselling of PPI's etc.

Robinson Way have returned the debt back to Barclaycard who have now sold it on to Westcott. I shall send them copy of the letter stating the debt is unenforceable - how long is this likely to go on for????? Any ideas????

I ignored last letter - just received one now saying they have contacted barclays and the debt is correct and payable. Note they did not say enforceable. They are demanding money. They can get a copy of the letter from Barclaycard stating the debt is unenforceable.

Yep it's unenforceable IN COURT BUT the debt does remain payable until you can state that it is statute barred.

 

Just send them this:

 

Ref: Use theirs,

 

Dear Cur or Madman,

 

I have received your letter dated xx xx xxxx regarding the alleged debt to Barclaycard in the sum of £xxx.xx as previously mentioned I do not accept liability for the alleged debt, and as Barclaycard have admitted to me in writing that the matter is UNENFORCEABLE IN COURT, therefore I will not now or at any time in the future make any payment in relation to the alleged debt.

 

I am aware that the debt. may be ''payable'' but it will not be paid by me.

 

This is my final response.
