Firstly - Sorry if this is in the wrong place, its my first post.

Please feel free to tell if its in the wrong place and I will move it.

 

OK, heres my situation

 

- Some may ask why I have left this so long and its simply that I knew I owed the money so was happy to pay what I owe.

 

Due to house moves and a "Dont Care" attitude years ago I didn't bother looking at how the figures were made up.

 

Now as I stated I did owe the money and am happy to pay that off but I dont want to end up paying interest if I dont need to.

 

I have a mortgage shortfall debt that I have been paying for a number of years now and wondered if I have a case to have it looked at again.

I have been paying through an AEO but it leaves me short every month.

I don’t think they worked the amount out correctly.

I have no problem paying what I owe but have been reading about how interest is calculated.

Key dates are listed below.

House Repossessed – 24/05/1996

Property Sold – 22/11/1996

Shortfall amount - £25,964.77

Court Action Date – 05/08/2008 (My ex wife had made token payments between 30/11/2005 through to 06/03/2008 - £10 every month)

CCJ Amount - £51,723.03 (This equates to roughly 12 years interest at 8% added to the original debt)

Could you advise me if they can claim the interest as six years had passed before contact with my ex wife was made?

If they cannot add interest,

could you tell me how I would go about having the order adjusted please?

(I have currently paid £20,700 off of the total debt through the AEO).

mortgage SB is 12yrs not 6.

 

whatever is in the judgement box is what you should be paying.

 

got all te statements?

 

got any PENALTY charges?

I thought I read somwhere that SB on mortgage capital was 12 years but SB on mortgage interest was six years. Or have I just tottally misunderstood?

poss correct on shortfall int

however what you should be paying and when, will be on the CCJ judgement box

Ok. Maybe I have not explained this very well - Appologies if I've confused anyone.

The claim box tells me I owe £51,723.03 and that I need to pay this monthly via AOE at a rate of £450 per month.

 

My questions are:

 

My original mortgage shortfall debt was £26,946.23 - The rest is what Drydens have added for interest ince the house was sold.

 

Can they add this amount of interest or should the interest be SB? There was no contact for 9 years, then my ex wife started paying £10 per month which as I understand it restarts the 12 year clock. From what I have read, the interest part was SB and should not have been added to the debt.

 

Can I get the court to adjust he total amount that I owe?
