      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just paid them what I am due(loan +1 months interest!).

They think that I am still due them over £800 in charges/interest!!!:violin:

Ha ha ha they aint getting another penny off me!

Be careful, because they might just do that. And the court wil need absolute proof that you dont owe what they state, thats IF they bother to turn up and represent themselves. Remember, the court uses information pertaining to your situation, not what theyve done to others.

 

Saying that though, 99% of the time these companies are all talk. the 1% of the time they do push forwards, they never bother to go to court. These companies completely rely on getting judgement by default in order to make HUGE profits.

Well well well!

After an email from Micheal Lapides and another from me to him.....he has agreed to close my account!

Finally my dealings with these scumbags are over!

 

Do not give in to these people,stick to your guns and use this site for help and support in dealing with them.

 

Only two more to go and im clear of payday loans FOREVER!!!

If he has agreed to close it, you need to make sure the agreement is worded specifically so they will not pass on, chase or sell any alleged remainder of the debt. These companies are well known for doing so, so 1-2 years down the road after they get shut down, another DCA comes calling and hounds you for the remainder.

Everything is in order,infact after logging into my account it states'loan paid in full'.

Also just recieved a text message asking if I wish another loan!!!! Unbelievable!!!

Another email to Mr.Lapides to get that stopped!

You need full confirmation in a letter or writing. having it state paid in full on a website is not acceptable with pdls.

I have email conformation from Mr Lapides that the loan is now settled in full. He also added that I wouldnt be able to use there services in the future!:lol:

Hello I'm wandering if anyone can be a huge help! I regrettably took out a loan of 400 pounds with speed credit, I owe them 501, as we know the site has been closed down, I believe they are linked to tooth fairy finance so I went to this site and clicked the pay now button only to find out it says my loan doesn't exist? I went back to speed credit and rang the number it gave which told me all loans had been passed onto northerndebtcollectors.com so I went to this site, clicked the pay now button, and that too said my loan doesn't exist? Can someone please tell me what's going on!? Thankyou.

Why are you worried? These muppets are just that. Muppets. They rely on threats and harassment to get money from you. Send in formal letters of complaint and get a full complaint into the OFT.

I guess I'm only worried because iv read too many of these comments about people being charged stupid amounts of money! I for one can not afford for that to happen! It's annoying because I have the money to pay back, but the site has been closed down and both sites say my loan doesn't exist? Which is really odd!

They can charge whatever they like. It doesnt mean the amounts are lawful, fair or that you have to pay it. Theres a reason why they are called "legal loan sharks".

Renegadeimp.. Or to anyone else that could possibly help... Hello there! Just a quick one, yesterday around 1-2pm I applied for a loan with tooth fairy as I have used them several times and never really had a problem, I applied for 400 and it was accepted immediately, texts and emails both to clarify this, yet today as I'm writing this I am yet to receive the money? I understand it hasn't been 24 hours yet which it says it may take up to but I normally receive it straight away, if it comes to say 3-4pm this evening what do you recommend I do? Thank you

Have tooth fairy not been officially closed down by the OFT, with all prior accounts being passed to web loans processing???

 

just done a web check on tooth fairy and they are now a group company of web loans processing, how can they still be trading, under a different credit licence number after the OFT shut them down

Toothfairy have not closed down. They used to have an licence in their own name but this was rescinded so that WLP could be the licence holder.

 

WLP's original licence did have Toothfairy already listed as a trading name so I imagine this is just a cleaning exercise

Were tooth fairy not under MCO Capital

 

That was the credit licence revoked

 

No. MCO had Speedcredit, Paycheck credit and another I can't remember. Where Toothfairy got involved was in collections which was where the confusions reigned. Peeps took a loan with MCO yet TF showed on their statements

Kinda right there silverfox. Toothfairy were under MCO capital a while ago, but then Mr larholt transferred the business to one of his sub companies that hold another licence.
