6 years with payplan...Need a better solution than paying next 428months

If you have all the paperwork then it might be best for you to start afresh and make your own debt list.

 

If you know there are default charges - you should send Subject Access Requests to the Creditors and obtain all the statements/data so you can start to reclaim the charges.

 

Do you know if there was any Payment Protection Insurance on any of the accounts ? It is possible it was mis sold and can be reclaimed.

 

It is strange that PP would enter a debt twice .. it doesnt matter if it is a joint account it only gets recorded, once !

 

Do you know if these accounts are still attracting interest ?

 

I have heard that PayPlan put pressure on debtors to enter into IVAs, I dont understand why they would do that ?

 

IMHO, you need to obtain all the paperwork from creditors by way of Subject Access Requests - that way you can see what the debts were at certain stages eg at Default, at termination, at assignment/transfer of ownership.

 

You need to obtain an accounting from PayPlan so you can see where the money has been going and then cross reference that with statements.

 

Unfortunately you are a home owner - it is highly unlikely that any creditor will accept a small F&F, unles, you can find something "dodgy" with the paperwork.

 

Halifax, were very naughty on some of their accounts and added Payment Protection Insurance without consent or advised it was mandatory.

 

Some other things to look out for - default notices - were they issued correctly - if the accounts were terminated - why is interest still being added ?

 

You can indeed self manage your own DMP - the creditor is obliged to accept this.

 

You certainly require an explanation as to why both you and your wife appear to have at least 2 debts that are on both your lists - are you paying these twice ?

They dont charge the debtor however they are funded by the Creditor arent they ?

 

I am not sure whether they receive a fee for IVA's.

hi huggy,

Some of the double entries are joint accounts which i presume they have halved and listed on both names. just that the £425 hasnt been halved. The debts are old so i have forgotten figures etc.

You and your wife would be jointly and severally liable for the joint debts so I think your figures probably show the joint debts twice. In other words if, for example, one of you went bankrupt, the creditor could claim full payment from the other. So effectively you both owe it all but it doesn't have to be paid twice. From the point of view of your joint debts, IMHO you only need to count it once.

 

Check this out though. Don't take my word for it.

 

Assuming you can make sense of what I said of course! :p

this is why im a little concerned with Payplan. thye just kept trying to rush me into this IVA. i just said no i dont feel comfortablein the end. im scanning the documents and posting here. not done it before. Might be awhile:!:

they would NEVER had checkthe debt WAS legally owed or assigned properly

thats twice now

 

here it is: in text

 

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

'

BUT......

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all figures and dates. {DO NOT USE A BIRO OR PEN OR USE SEE THRU TAPE OR LABELS]

DO NOT USE ANY PDF EDITOR TO BLANK STUFF, THAT CAN BE REMOVED

DO IT IN PAINT.EXE or any photo editing program

convert existing PC files to PDF [office has an installable print to PDF option]

..

goto one of the many free online pdf converter websites [http://docupub.com/pdfconvert/]

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

i'e Default notice dd-mm-yyyy

.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

i think the fees are what iswould cost you to use a legal person

 

some of these arrangement require their involvement.

 

as for your debts

you are certainly doing the correct thing by getting the SAR's done.

Hi DX,

i only have one left on file. the other have come off after 6 years.

 

i have been thinking of paying that one off.

 

its the only red i have against me on my equifax file. defaulted on 12/8/2008.

 

So it has a couple more years to run.

 

Will it help my credit score if i do?

 

whats the best way of approaching HSBC?

 

Full or final offer or just give them £500 and be done with it.

 

regretting not doing this sooner if it would of helped my score.

paying the debt will not remove the default.

it would be marked as setlled, but, the default would

still show in the history.

 

who owns this debt on the CRA, still HSBC?

 

as for the ones that dont show.

 

they have dropped off as passed 6yrs since defaulted.

 

imho you need to start firing off a few CCA requests

 

ESP to link and marlin

 

if they cant produce one

 

stop paying

 

same for ALL your debt.

 

dont forget

bank accounts are not covered by the CCa though.

as to your previous post. HSBC still own the debt. metropolitan sent me a letter in 2008, but thats the last i heard from them. think payplan are sending payments to HSBC. Also is there no point sending a SAR to bank account defaults?

need to clarify some things

 

a CCA request goes to ANYONE that is demanding money off of you

to check THEY have the correct paperwork [link marlin etc]

 

sadly bank accounts are not covered by CCA as such

so you cant do that for them.

 

an SAR is a request to an organisation for them to furnish ALL details they have on you.

account statements etc etc

 

IF as you are saying that NONE of the debts payplan are payin now SHOW

[bar the HSBC one]

 

i would CCA those you can.

 

sadly PP did not in the era of your plan start EVER check

debts WERE legally assigned.

 

they took it on spec, those demanding should be paid.

 

it scares me, but i think you have been p'haps cash cowed here.

 

i would now dump PP and do things yourself.
