    • Yep, those 'requirements' not met to shareholders satisfaction seem to me to be: 1. Not being allowed to increase customer bills by 40% (of which well over 50% of the new total would NOT be investment) 2. 1 plus regulators not agreeing to letting them do 'things in their own time (ie carry on regardless)
    • As already mentioned freely available "credit scores" are fairly useless. All lenders have their own "credit scoring" system, that for obvious reasons they don't divulge. And they're "scored" differently to the freely available ones. As soon as they could, we've always encouraged our two children to use credit cards responsibly... Pay off in full, etc, to generate good history. It's paid off. At quite young ages, they have both obtained loans for cars, mortgage and their credit card limits are through the roof. Personally, I have shifted debt around a lot on credit cards (even financed a house purchase once at 0% 😉) and I've only ever been refused a credit card once, sorry twice by the same company, over many years. They must have something very different in their lending criteria. You're a tight one, Mr Branson.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there,

 

I have been employed for a few months and as my luck sometimes plays "hide and seek" I would need a proper reply to a letter received regarding the reason as why I have left.

Right, now:

I have been employed to an old (job)colleague which happened to open a business. As I was looking for a job the opportunity was opened up to work for him.

Ready to take the job after the interview he said that I should take the General Manager although I went as just Front House Manager but I have accepted it as i really wanted to learn extra.

Anyhoo, after 6-7 months in which I have done everything I could possible do to not only deal with the customers but to bring excellent comments, teach the team how and what to do to go the extra mile, increased sales with 15%-20% although due to his wrong decissions taken by the owner we all have to suffer: less employers, less money,etc.

Now - 3 months before I left,( due to his words and acts - explaining down), he came to me and said that I am not managing anything....and that I should be demoted (from GM to Assistant Manager) and to take a pay cut as well....???? It came as shock to me - as I have worked every day 10-11 hours running up and down so my feet would feel numb, good comments and a greater amount of people would pour in.... To mention that I work in catering.

Even a few days before I realy wanted to go to him to say that if there will be problems with money It could be paid even a bit less as he was always telling us that he doesn't make enough money. As I didn't have a choice than to save the job and the business in which I really put with all my effort and heart I have accepted verbal. To my surprise the Head chef didn't take any pay cut but everyone else did. The head chef started to raise his voice, shouting especially at me and said that "Everyone here is rubish and s..t and we don't know what we doing although everyone did an amazing job working as a team. I then told him to calm down as customers arte hearing the swering an the abusive leanguage. Second day I have informed the owner as it wasn't the first time that happened and that I will not tolerate any abusive language. The owner said that he will look onto it and he will have a word with the Head chef. He didn't even mention it days later as I have asked him what was the outcome and his reply was that he has spoken to him...but nothing else...Then it happened again a week later, then again and again. I have decided to write a Formal Letter addressed to the Head Chef and the Owner and if that will happen again it could lead to the Chef Dismissal - so the following was to DEMOTE ME!!!! Here i went again to talk to the Owner about it but he then again said that he will show him the letter....which I didn't think he even did. Anyway from there on until I left even the waiters/barman/waitreses were afariad to go to the kitchen if there was any mistake. I really couldn't stand the situation anymore and although I have verbally said nothing would happen. I really started to worry about the situation. The salaries were paid late all the time to me as well as everyones although Head Chef was getting his money on time. I went in holiday in 1st Nov 2012 and on the 31 Oct I have even texted him and asking about the salary..as I will need to take with me. He assured me that the funds should clear on 1st Nov into my account...no way. He paid me less money...then I have asked while on holiday were are the rest of it and he said that it will be with me soon...which was on the 8th Nov. I was worried the whole holiday about it as I needed the money to pay for one's of my friend marriage as I was invited... The whole thing became clear that I have been not only harrased at work but pushed aside from every single side. To add that every time was a change (wheather was financial, procedure,etc) which supposed to be brought to everyones attention I was excluded and that I have felt for the last 3 month. I have decided that my health was much more important as I could not even sleep properly every night, and that I will not return once back from holiday which I did. After I left I have met one of my colleague which the Owner gave him the Assistant Manager position was kicked out one day turning up to work. He said that his girlfriend was kicked out in the same way a few years ago...

 

So I have claimed JSA and they said to put down the reasons and I need to know how to formulate the whole thing as I know that the Owner will do anything for the money....

First question: 1- Explain full reason to why you left employment

 

2 - did you discuss any problems were having at work with employer before leaving (dates, whom did you speak, what was the discussion and the outcome

 

3- Explain what other steps you took to resolve the problem that cause you to leave including name of people

 

4- Give details of any urgent and pressing circumstances that cause you to leave before finding alternative work

 

5- did you look for alternative employment before leaving. Also attach any details of employers. addreses etc contacted

 

6- If you did seek for alternative employment before you left explain why.

 

Any help will be much apreciated AS i HAVE TO REPLY WITHIN 3 DAYS

All you can do is answer the questions as honestly as you can as if you don't reply a decision will be made without your reasons.

If you don't get the information in on time and it is received late they may be able to use your information as late evidence or a reconsideration request if a decision has already been made.

Hi Flumps,Many thanks. I just wanted to have the owner out of any trouble as I don't like to have anyone in the spotlight....Once again many thanks,DD

The DMA team (the ones who require this information) are not interested in getting your former employers into trouble, they are looking at the payability of your JSA and if you had good reason for leaving your job and claiming JSA.

Thank you once again... That is a relief as I could not sleep as to put a former colleague into trouble would not be myself although that is what has done to me.

The only thing is that they have mentioned in the letter that they will probably showing the letter to him and the Truth hurts sometimes although I have brought the facts to the Owner at the time - late salary paid, no paid enough, abusive language used and not dealt with various times, etc...I could have a big list but leave it to just that.

 

Anyway, cutting short I hope that I will be employed before :)
