Hiya, can someone please send me a link to a template/wording for cancelling authority for WONGA to take money from my account (the one to send to WONGA not to the bank)?

The loan is due to be debited tomorrow, I have cleared my account and rang Natwest to cancel CPA- they told me they would request WONGA not to take payment but could not cancel, however would refund any money should WONGA take it at any point....then went on to say that if WONGA changes the name it uses to try and take money they cant do anything about it and that I am wrong about the FSA regulations....feel so helpless I think Im going to have to close my accounts......:(.......

 

...but I do need template or wording to email to WONGA now....anyone have the best email addresses to use in order to get a decent response and acknowledgement back from WONGA also?

You need to send one to wonga and a specifically detailed one to your bank. WOnga and other pdl's are well known to just ignore the instruction completely.

 

As for natwest, have a read of http://www.consumeractiongroup.co.uk/forum/showthread.php?336569-How-to-remove-a-lender-s-continuous-payment-authority(1-Viewing)-nbsp and dont listen to any of the crap they give you. Your rights are enshrined in law, no matter what natwest try and say.

Ahhhhh its so frustrating I really want to cry with frustration and anger, they offered to put me through to the 'Manager' on the phone who is apparantly 'well informed' about the FSA regs and she would explain but I just hung up as I knew I was getting upset at not having the correct way to word things and didnt know what to say when they kept saying 'no thats not correct unfortunately'......I feel like a know-nothing customer against a baffle-u-with-b#ll#ocks bank manager...... :(

Ok. DONT talk to them on the phone, for any reason. Keep everything to emails, or letters sent and tracked by recorded delivery.

 

Im about to go out for an hour or so, but if nobody else has replied when i get back, ill help you with a few letters, and some links so you can have a read up on various regulations/guidance rules and set your mind at ease.

 

The absolute first thing you must do is secure your finances, which may mean getting your employer to pay your wages into a brand new bank account. If PDL's have access to your card and bank, you can be sure that they will debit it for as much as they can, whenever they can.

Ok, who or what department do I email at Natwest please renegaideim, would you know please?? I tell my mother this all the time with different things ''keep a paper trail mam'' and then go completely against my own advice. Righty o- pulled my socks up and wiped my eyes...fingers at the ready.... :)

You dont email anyone. You write the letter up and hand it in person to your nearest branch. They copy it, and sign and stamp both copies, handing you one back. Once this is done, should any money get paid to the lender, the bank MUST refund all the money by law.

Right, that was my initial plan when I first tackled all of this crap but was feeling a bit intimidated incase the manager wouldnt sign it or something...does it have to be anyone in particular ie manager??

Natwest also said that they cant touch my other account as Ive never given authority...now not so confident as they just seem to fill you with hot air...

Hopefeully the co-op will get back to me with a new basic account this week and I can relax a bit.

Important: For the letter to your bank, you must give the instruction to them in good time before the money is due to be taken. This is normally before close of business the previous working day. It is usually a good idea to hand it in a few hours before close of business so they have time to update your account, and cannot make any excuses if they fail to follow the instruction.

 

 

To cancel payments TO wonga, hand this letter into the duty manager at your bank in person. Get it photocopied while you are there, stamped and signed. Keep one copy.

Dear Sir,

 

Please cancel and decline any and all transactions that are to be made, or are in the process of being made to the following companies: (insert companies here. Make sure to find out the merchant for your PDL too and enter it here). This includes any use of Continuous Payment Authorities that may lie on the account.

 

Under Regulation 55 of The Payment Services Regulations 2009 section 55, you are legally obliged to comply.

 

 

Sincerely

Thats all you need to write. Remember, do NOT leave the bank until you have a signed, stamped and dated copy, no matter what the bank does or says. It does NOT need to go to the bank manager, a duty manager can do it, and if they are not around, even a cashier can sign for it.

 

Once you have the signed, stamped and dated copy, you need to keep it safe, as this is your conclusive proof the bank have failed in their legal obligations should they let the lender have more money.

 

Please note that the cancellation only applies once they recieve this letter, it cannot be backdated, and if the lender have taken any money out previously, it must be dealt with separatley.

 

 

 

Now, the letter for wonga is simple too, make sure you send it via email and get a read receipt, or by Royal Mail Recorded Delivery and make sure you track it:

Dear Sirs,

 

In reference to the above account, i hereby withdraw all permissions to you to debit any monies from the associated bank account or debit/credit card. Should you attempt to take any money from the aforementioned account, i will be issuing full and formal complaints to the OFT and will make a comment on your fitness to hold a credit licence. I have already given my bank the legal instruction to decline any and all transactions to your company.

 

This letter/email (delete as appropriate) will be tracked as proof of receipt.

Those are basic templates for you to use. The bank one can be sent "as-is" editing it for your own info. With the wonga one, have a read of it, and edit it to your own words. Anything in red can be edited if you want an easy template.

So sorry renegadeimp I hadnt realised you had replied as my inbox didnt notify me, thank you so much for your help in this its really great. As I didnt know you had replied I had in the meantime emailed WONGA.....heres how my email went.......

 

Unfortunately since making the above loan agreement with you, my

circumstances have changed and I cannot now afford the previously

agreed loan repayment due today 17/01/2013. This is because my

financial situation has become overwhelming and stressful due to many

factors mainly unemployment and a new baby.

 

In view of these circumstances, due to the fact my income is made up of

only benefits, I am willing to offer XXXX per month at present.This is

a very temporary token payment offer and I will be able to review this

amount in APRIL 2013 when I expect to be able to increase this payment.

 

If interest or other charges are being added to the account I would be

extremely grateful if you would freeze these so that all payments made

will reduce what I owe, therefore enabling me to clear this debt as

quickly as I possibly can.

 

I would like to inform you that I withdraw any authority for WONGA to

take any payments from any bank account which details I have supplied

you with in the past and hope that you respect this as my current

income is made up of Child Tax Credit and Child Benefit alone and to

take this from my account knowingly after informing you of this will be

I also request that you contact me via email or letter and that you do

Think Ive covered most of the usual stuff, I have emailed them again with your template letter regarding the withdrawing of my authority so thats twice Ive told them now......going to email it again to the numerous email addresses I can find on here for WONGA.

As for the bank Ive emptied my benefits and havnt been able to get down today as the snow and ice up here is treacherous today...I plan to hand it in either tomorrow or monday, I have rang Tax Credits and Child Benefit to get my money paid into a Post Office Cash Account and await the application pack, in the meantime they are sending my payments via girocheque for a temporary period until I sort out a more permanent account.

Whta do you think of this email does it cover my back with Wonga do you think?

Hi renegadeimp, our income as a married couple with 3 children is composed solely of child tax credit, child benefit, a small child suport payment and my husband is a fulltime student so he recieves student loans also.

I used to be self employed and when I was mid pregnancy went on maternity leave and was in reciept of maternity allowance however that has now stopped as of july 2012, therefore we no longer recieve working tax credit or the MA so our income has significantly reduced since then, have been borrowing from peter to pay paul, scrimping on grub etc but after the stress of christmas and worrying about where the moneys coming from for nappies or how the hubby's going to get to uni I just refuse to do that anymore. My hub is due a student loans payment in April so hoping to pay a lump to each creditor then and thereafter each time as long as its comfortably possible but at the minute we have zilch.

Then tell wonga since you and your partner are not employed, they will be getting £1 a month.

 

If they ever tried to take you to court, and you are both unemployed and on benefits, a judge would agree to £1 a month or even less. (Completely dependant on total income and outgoings). As long as you let wonga know, and keep them informed, they would look very VERY stupid if they ever tried to issue a claim. They would also be in violation of their credit licence if they insisted on adding on interest and extra charges when you have made it clear you cant pay them.

 

The most important thing is you keep the lender informed and do it in writing. This shows that you have tried to negotiate and cooperate every step of the way.

Well, Ive already made the offer of £5 which I can manage right now but I suppose if they piddle about I may have to re-evaluate my situation and tell them theyre getting £1, then pay what I can when I can on top of that. I will keep them informed regularly.

I am waiting for my other creditors to default before I offer any kind of repayment plan as I would like the defaults to be put onto my file asap so the 6 yrs can drop off sooner rather than later as opposed to an AP. Hopefully this is a wise move...?.. hate having things hanging around my neck so I hope they get cracking...

It has made me rethink my way of handling money if Im honest, Ive always been quite frugal and try to be careful with banks etc but now Ive decided Im just going to have that basic Posty account and they will all get paid by slips where possible or if the co-op gets back to me I will be setting up SO's from there and keeping one acc for IN and the other for OUT. Why I didnt just do this all along who knows...

 

Thanks for the support I appreciate it, makes it all seem minor in the grand scheme of things...us getting fed and watered come first along with my sanity :)

Y'know what I think may even just close the bleedin Natwest accounts, what a pain in my neck they are proving to be with all this business... Ill just be worrying all the time so its more hassle for me to keep them open in the hope of them being 'safe' one day. Back to basics :)

If you can think you can afford £5 a month, then by all means pay them that. You can always add a clause to your payments where you will re-evaluate your circumstances in 3 months, 6 months time.

 

As for other creditors, please remember that wonga is a low priority creditor with as much right to your money as your milkman. It might be a good idea for you and your partner to create a full I&E for your own use, and then complete a budget summary so you can see what you can pay each creditor. Remember, high priority debts such as rent/mortgage/water/food/car fule etc come first. if after all those there is only 50p left for wonga, then thats all they get, whether they like it or not.

Well if I went by our own I&E we would have minus money if the amounts suggested on many debt help sites for food and clothing etc were applied.......we are just making sure our gas and leccy are paid along with having a decent amount of grub in and nappies/milk for bubs. The car is broken so we are forking out metro/bus fares for hubby to get to uni aswell...clothes and stuff like that just arent do-able right now and we have clothes on our backs so we are lucky compared to some unfortunate souls.....all this is on the hope of things getting a bit better come April though and I will have a little bit to spread between them, it will be a very small amount however but a payment nevertheless.

Just to update also, WONGA emailed back with a generic 'telephone us to discuss'....'we are here to help'......and so I just responded with an email saying that I felt my initial email was very clear and that I was eager to pay something, I copied and pasted into it the first emails I sent and re-iterated that I would like some payment details from them and repeated they were not to telephone me nor would I be telephoning them.

Feeling quite good about things, one down...sort of....a few more to go.....

Well the courts would say pay your priority bills, then make sure you have some left for "socialising", then your lower priority debts come into play. If that means they dont get anything for a few months, then tough luck to them. If they add on charges etc as i said before, then they are in breach of their licence.

Right... sent numerous emails regarding them sending me some bank details and withdrawing my authority for any payments from my account.....theyve sent the bank details and Ive replied confirming Ive set up a standing order and detailing how often and how much. I have said I require confirmation from them that they wont debit any money from any of my accounts and have reminded them of my previou emails stating my withdrawal of authority, I also stated that the fact they had replied in response to the 'withdrawal of authority' email serves as proof they have recieved my notification of this...

see what they say.....however they havnt confirmed they will stop interest and charges but Im not worried at this moment....can deal with that when they confirm they wont debit any of my accounts I suppose.

 

Do you think this covers most things??....

You need to get them to confirm that they will not debit your account. Thats why we now say ( and the FSA says too), to go direct to your bank and cancel it that way.

Sorry, I did mean I'd emailed and withdrawn permission via WONGA, I havnt been into the bank as yet as the weather is atrocious here. As the loan was due for repayment last week I withdrew my money and have notified tax credits to send my money to me via a girocheque for the time being so I wont be out of pocket in any instance and therefore allowing me to relax in the knowledge my benefits are safe for now so I can muster up the courage to fight a bit.

Natwest have 'requested' that Wonga do not take any more money and have stated they will refund any that they do take....however they did say if they try and take it under a different name or a different kind of payment type(???!!) that they couldnt stop it...anyhoo I know thats crap and my letter telling them so will cover this.

 

I want WONGA to confirm they wont take any money from my account mainly as matter of principal if Im honest...I dont want to close my account so Ive decided Im going to try and stand my ground by hopefully getting both the bank and WONGA to admit the law. I think its important that I at least try in order for companies to realise they MUST abide the law, instead of pulling the wool over peoples eyes. Especially those who take their word as gospel, like I would usually do.

My money is safe but thats not the point I feel.

See if WONGA respond.

Ok. You really need to get it in writing, and TELL natwest to cancel it. Do not let them say they can only request it. Under a law passed in 2009, the banks are legally obliged to comply or face penalties.

I did tell them to cancel it when I called but they continued with the 'we cant blah blah blah' and I did say 'its the law' but they just kept waffling on. It could have went on allday like that....so other than saying that its the law and giving them a letter stating this what else can I do if they just say 'no thats not the case'..?

Is there a place I can ring to back me up or something like the FSA or OFT who will give me some sort of ref number to give them? How do I get someone to sign a letter if they point blank refuse? Will a letter to Natwest in the post be sufficient? Can you see where Im coming from when they tell you they know better..... I feel intimidated and nervous when they tell me Im wrong and I felt like I was getting nowhere when this happened over the phone.
