I really appreciate it.   As a nurse i am part self employed and part PAYE ( i think i had mentioned that in my initial post#1).   But I totally agree, everything should balance out.   I have kind of worked out how much I owe them. I wont be able to pay it all because I am short of funds. The hospital had delayed processing one of my invoices and so the payment may r may not be in my bank account by the end of the month. I dont know that. If it does get into my account then im Ok paying my tax. if not then I wont have enough.   How should I play this? Shall I call HMRC and give them advance notice, stating that I may not be able to pay the lot as a lump sum? I have called the hospital and tried y best and they promised to pay me but they have let me down in the past, so I remain in limbo whether they will pay me in time or not

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

2 year old orange phone debt and lowells DCA - default removal

Hi all,

 

I recently got hold of my credit report and was happy to see that it doesn't contain any old debts which are over 6 years old.

 

However, I have a 2 year old mobile phone debt that has been passed to a DCA that I would like to pay off and that is showing on my report.

 

The problem is the same agency is still chasing me for another debt even though I haven't contacted them for over 6 years (maybe 10) but this one does not show on my report.

 

My questions are

1) if i pay the phone debt will they then be able to stick the other debt back on my credit report and / or pursue me for it?

 

2) will other DCAs also come out of the woodwork sniffing around for some cash?

 

My main point here is that I'd like to get my credit rating back to good or at least normal (I'm less worried about threatening letters since the debt is well over 6 years old).

Even if you pay the 2 year old moby phone debt it will remain on your credit file for six years, and DO NOT pay the DCA (who is it) Pay the OC direct.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

If Lowell are involved, the account has probably been sold. Have you ever received a notice of assignment? Who is shown as administering the debt on your credit report?

Yes. My report says it is Lowell. If I contact them about this debt I don't want them to open the case regarding the old one. I am not sure why they just don't attach a payment slip to the letter.

The debt is showing on my credit report as an 8 (The account is in 'default'. You failed to keep to your credit agreement and have not responded satisfactorily to requests to bring your payments up to date, so the credit agreement has ended.)

 

Orange said they no longer have the debt and it has been sold.

Not necessarily. May have come from Lowell. It would have stated that your account has been sold to Lowell. Could come from either company.

i would suspect there is something wrong with the account

 

they rarely sell anything but lemon debts.

I thought moby debts were a service agreement not a credit agreement? Or am I missing something?

Hi all,

 

I can't find the letter to say that it has been sold to a dca

but I'm pretty sure I had one and just threw it away, my mistake.

 

Hamptons (?) have been trying to contact me so I assume they have the debt now.

 

I ran up 1k in phone bills due to crazy data roaming tariffs and over seas calls when I was working.

 

Someone I know was recently declined a mortgage due to an unpaid phone bill that appeared on his credit report.

Use the template from the CAG library there is £10 statutory fee to pay they have 40 days to comply so send addressed to The Data Controller by recorded delivery so you can check when they receive it the 40 days start then.
