Going in to hospital

If someone has to go in to hospital and they currently claim HB, CTB, ESA and DLA I know they have to inform the LA & DWP straight away and after a set number of weeks they stop receiving some benefits.

 

My question is wrt non-dependent disregards. If the person has young adult non dependent children at home who are normally disregarded as the person gets MRC/LRM DLA, when the DLA stops as they are in hospital does this remove the non dependent disregard so as well as the loss of benefits the hospitalised person needs to fund extra rent and council tax, or as the DLA is only 'suspended' while they are in hospital is the non dependent disregard held in place even though the DLA is not in payment?

 

The above is the important question but if someone knows the amount of weeks for each benefit before losing it once in hospital that would be great.

Yes, wasn't sure if it was 4 or 5 weeks but all agencies would be informed anyway. Just wanted to know about the non-dependent disregard affect on the children, does anyone know?

 

Also one of the children is in part time education and claims IS and CA for the mother, I guess they would lose all that too?!

 

Specialists want the mother in hospital but I can't see it happening unless very short stay and the treatment required isn't a short course.

The IS and carers can continue to be received for a period of 8 weeks after the DLA ends, fingers crossed it won't take that long as a stay in hospital,

Thanks flumps. Do you know about the affect on the non dependent disregard, does it end with the DLA or does it continue as the DLA is just 'suspended'?

I don't know for sure, and I did some digging around, but no answers. So to me this suggests that the disregard would stop after 4 weeks with the DLA. But as I said, not 100% sure.
