Can I get the bankruptcy costs refunded from Lowell

Hi All

 

If I have never been served with the bankruptcy petition and the court will be throwing it out on Monday because I haven't been served can I get the costs deleted off of my debt? I have only ever had it verbally told to me that costs had been added.

 

There is an extensive thread about this debt so we do not need to cover it again as the debt has now been acknowledged and a payment plan set up.

 

The court states that Lowell filed the paperwork with them in September but waited til November to start to try and serve me - they were not available to serve me when I was available.

 

Lowell stated verbally that the costs were £412.

 

Any ideas?

What you could do is write to Lowell requesting that these are refunded by reducing the debt or if they feel this is not required to issue a final response, as you intend to ask the FOS to look into a complaint. The FOS will look at such complaints, as these costs were added outside any court process. When you make the complaint to the FOS, also make a complaint to the OFT, which you may have done already, but this is a complaint specifically about these costs.
