Hi Everyone, i'm after some advice.

 

I took out an unsecured loan with Alliance & Leicester back in September 2008.

 

Unfortunately I was unable to make the repayments after 10 months as my ex-partner was made unemployed and we were facing repossession on our home.

 

The last payment I made was in July 2009.

 

The company then became Santander and the last letter asking for repayment I had was October 2010.

 

I had been unable to make any repayments on it since the last one in 2009.

 

Fast forward to yesterday.......

 

I come home after staying away with family for a couple of weeks to have received two letters from moorcroft debt recovery.

 

The first one asking to confirm whether i indeed at an outstanding debt with Santander.

As i was away they didn't get any response.

 

I also had another letter saying i owed just under £5,000 and were threatening litigation.

It said they "may" have no other alternative but to pursue legal action against me.

 

I now don't know what to do.

I am currently unemployed and every single spare penny i have already goes to other more important debts.

Can they really take me to court straight away, only a couple of weeks after the first letter?

 

Any advice much appreciated, thanks.

Moorcrap are a DCA

 

they are NOT BAILIFFS

 

they have NO SUCH LEGAL POWERS.

 

unless they OWN the debt.

 

all hot air as you have found full if if,might,may,instructed etc etc

 

they don't buy debts anyhow.

 

now about this debt & p'haps your others too...

 

 

Have you checked your CRA file to check ALL your debts show?

 

have you worked out which ones are PRIORITY debts?

 

might be best to list them here.

 

how big was the loan?

 

and what was the last true balance from satans bank?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

moorcr@p will do nothing but threaten and bully you with 'red' coloured letters and lots of 'we may do this' and we may do that rubbish....but they have now had since 2009 to take court action and absolutely zilch has happened....if you have paid nothing since that date another 2 years and the debt becomes statute barred.....

I hadn't checked my CRA file, and i'm glad I did now.

 

The Santander one is definitely on there.

Though I am currently paying off a HSBC credit card debt to metropolitan which is showing in the closed file as "satisfied"?

 

The original loan was for £5,000 (£6,867 inc interest).

I paid back £1907.50, but i don't know the true balance as i can't find any paperwork showing it.

Moorcroft are asking for £4, 751.

 

The debts are have and are currently paying off are my rent and water arrears and the HSBC credit card debt.

 

I was paying off another debt to Lowell but couldn't afford to make the repayment in december.

met are the inhouse DCA for HSBC i think.

 

time to CCA them & SAR HSBC.

 

your gonna need to SAR satans bank too to findout about the debt

 

if you want to stall moorcrap, CCA them too.

Do Moorcroft own this debt or are they acting on behalf of the creditor.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

I don't think they own it, it refers to Santander as their client on the letters?!

Then THEY cannot start litigation, can only recommend it.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.
