Hi, I'm new here and can't find how to post a new thread - so I'm trying this!

 

Acouple of issues. My ESA was stopped from 4 December, but the med. certificate took me up to 17 Dec. I've sent off

the Gl24 to appeal but my GP said he's not allowed to issue another med.note to cover a period already covered

by one already issued. Yet I read somewhere on these forums that it should be made out FROM the date when

the ESA claim was stopped. So I'm a bit confused about this.

 

Secondly, a person might be wrongly assessed as fit for work and so receive no extra ESA money during an appeal and yet

a few months into the appeal process recover - perhaps after having an operation. He will then turn up to any tribunal as right as rain and yet had nevertheless been unfit for work prior to the operation. How is he to prove to any tribunal that he was unfit for work before the operation and so should have been receiving the increased ESA payment? In my case I'm waiting to have nerve block injections (the doctor said it might then be necessary to destroy nerves completely for extensive cervical disc degeneration. I'm in great pain now but might not be in a few months time!

There's no issue with having a a fit note which overlaps the other. I've done it and nothing has been said. You just have to ensure that there's no gaps.

You're fine with the med cert - just ask for a new one from December 18th and send it in.

 

As to the other question, the tribunal will assess how you were at the time of the medical, not how you are on the day of the hearing itself. One of the members of the hearing panel will be a doctor, so your best bet would be to gather evidence (reports, letters and so on) from your GP or specialists that demonstrate how you were then.
