Hi all.

I am looking for some advice. I run a small one man band business - it is a limited company.

 

1. does the UTCCR apply as regards a contract between a small business and another business? is our business a "consumer" as regards the UTCCR when signing a contract with a telecommunications or utilities company as this is not part of our normal trade?

as per R&B Customs v UDT ( i know this relates to the UTA 1977 )

 

2. can anyone point me to cases or legislation that applies to show that above if the case.

sorry, it is B2B and you can get mightily ripped off if not careful. Telephone and leccy for a business premises are not purchased as a consumer end user because they are solely for business purposes. if the telephone is a home number as well that makes you a customer. Becomes awkward when you have 3 phase to your garage or shed at home.
