Barclaycard Help Required

Hi all,

 

Ive recently received all statements for my Barclaycard account, which fall within the last 5 years.

 

Ive whittled out all the charges, all fourty eight of them at £12!

 

So Ive entered them into an interest spreadsheet I downloaded from this forum. The total inc interest is £1074 based on a rate of 29.90%APR.

 

So my first question is, is this the correct rate to use for a claim?

 

My next question is, what is the next step once a claim ammount is finalised? Could someone please point out the correct letter template to use?

Hi Stan,

 

Although some folk have claimed interest in restitution at a nominal 29.9%, I personally suggest users use a rate of 24.9% as this would be more easy to justify before a court if the case gets that far.

When you come to do your POC's, take note of the advice here - http://www.consumeractiongroup.co.uk/forum/showthread.php?370304-Shelley-v-Barclaycard-Unfair-Charges&p=4028386&viewfull=1#post4028386 Statutory Interest (or s.69 interest) should only be claimed at 8% and not the higher nominal rate.

Letter received from BC today, basically saying they reject my claim and that basically all charges are above board.

 

How do I reply to that?!

Ok due to starting a new job there has been a bit of a delay on this. I sent them a final letter giving notice of action, and received exactly the same reply as before; that they claim all charges are lawfull and justified.Do I need to start filing a claim at the local courts?

Start court action via CCMCC, Salford.

 

Make sure you get your POC's right before you file the claim and see these threads for examples. Go through them and make notes of all you may find useful :-
