Hi,

 

i was appealling against a final written warning and the allegatiions on that were astounding.story below..

 

My x boss instigated alot of psycological bullying towards me, detremental remarks about my gender,( im a female supervisor in a male dominating enviroment,) and that caused me a great deal of stress and mental depression, not to mention the bullying i was receiving from some of my work colleaques too...i was up at an investigation meeting with him, which made me feel really uncomfortable as i did not like bieng alone with him at any time..it was an awful situation to be in..i was so stressed out that my mind just was not 100%. i signed his allegations against me, not really knowing what i was doing..until i received them through the post..i broke down into several bits, how dare he write that about me, he instigated the lot..i appealled against his allegations, then went to an appeal meeting with my statement against him. i was told there that they just wanted to put all this behind me, put it to bed, but could they have a medical report to understand my mental state between certain dates..i obliged. it took along time to come through, to which i am still waiting on the outcome to that too... anyway, i was back at my job because i appealled. we got a new stand in manager end of october last year, he was ok, until he got talking to the works bully..then everything went down hill for me after that...i now find myself suspended on full pay, and have been since november 26th 2012...how long does a suspension take?

how long does a suspension take, how long is a piece of string?

 

all depends on the nature of the issue and if there are complex elements to check through

 

e.g

 

1. you punch your boss in the face in the middle of an award ceremony with 100 people watching, this would be a short suspension because the facs are open and simple to prove

2. You are accused of fraud, police involved and it takes weeks to months to go though

i cant see how comlex my case is. unless they were investigating my x boss. he was demotted and put of my site, and was doing undercover stuff, and his manager was looking for something to sack him on as he was upsetting everyone in his new role. i heard that he was sacked before christmas, which is a blessing to me, as he did cause me no end of stress and mental torture. anyway, im guessing that my medical report has stirred a few folks in management, as i am not the kind of person that does not elaborate things, no point in keeping things hush hush, especially if your having to relive incidents from your past that you would rather keep in the back of your mind. we go to work to do our jobs, not be tortured everyday..i was told that being on suspension with pay for any unreasonable amount of time comes under the "contructive dismissal" heading and that i can put a claim in. but i am hoping that im out this length of time to recover from everything ive been through..because you can claim compensation for the mental and psycological damage that you suffered in the hands of the bully..

i read it on an employment law site. if the suspension drags on, in an unreasonable amount of time, it can be classed as a constructive dismissal against the company. as the ACAS code of practise states that suspension should be as short as possible, as it is not good for the employee or the employer. i am on full pay, but just hope i get it, because i can put a grievance in against my company for non payment of what i am owed. i did not want to go down the road of lawyers and claims, but if i am forced too, i will...come the 10th of january this month, i am going to have to start procedings against my employer if i am not payed my monthly wage, its the waiting that is driving me up the wall. just seems along time to wait to sack some one, or go down the disciplinary route. why wait to deliver bad news? i just dont understand...

your first post says you are suspended on full pay so why do you think you will not be paid?

 

"unreasonable" is a very very subjective word. I don't think it is at all wise to resign and claim CD. I'd sit it out.

sorry, i didnt explain properly, fletch. last year we had a stand in manager covering us until we got a permanent one. being the supervisor i had things to do around the site. when i returned, one of the customers engineering managers came in and asked why a contractor was on site without coming to his window for a permit to work. i told him in a very concerning voice that i knew nothing about the contractor being on site, as i had just arrived in the gatehouse. he persistantly went on about it, i told him that i would get back to him once i knew the facts, but he kept going on and on and on about it, blaming me for the contractor being on site. i was very distraught and upset, that i was getting the blame for something i knew nothing about. as the day went on, i was escorted off site that was the 26th of november 2012. i was summoned to an investigation meeting the following Thursday. During that time off, i wrote my statement out. took it to the meeting on the Thursday. I was given the statement from our then stand in manager and the engineering manager. our stand in manager claimed that i was shouting and was detremental towards the engineering manager. the engineering manager statement had a lie on it, and denied his claim. my statement was read, and totally did not match the engineers statement. i was asked at the meeting if anything had happened before the incident, i said yes. so i told the truth. But got really upset and burst into tears. i also said that there have been all sorts of set ups against me long before this incident, and being honest and truthful i mentioned some stuff. then i was told to send by email, txt message or phone if i could remember anything. the meeting ended with the statement, you are suspended on full pay, no contact with anyone but myself- Regional Accounts Manager- so i emailed her with alot of stuff that had being going on at work against me...to be honest, i dont know why i am suspended. maybe she was investigating the stuff i told...

Emmzzi, to get payed we book ourselves on and off site, its all done electroniclally. the only way that i will get payed lays in the hands of my Regional Accounts Manager. she phones wages and requests that i get payed and a BACS payment goes into my account. i have tried to phone her, as she is having technical problems with her emails...thing is, no one has any trust or respect for anyone in management because they have all been treated so badly...i dont want to go down that road and disrespect anyone, as i dont want to end up thinking they way other people on site think. its so negitive..

this is absolutley so unreasonable sitting here this length of time and being suspended in mid air...its enough to drive you to drink, suicide and all sorts. im guessing im up for the sack anyway, so why the hell leave it this long...im suffering as it is...ive got alot to lose...may as well die tonight in my sleep because im such an awful person..hated by everyone...

1. 2 - 3 months is not uncommon so please calm down. You are not being singled out in the big scheme of things.

2. We're not really health counsellors here - all we can really do is suggest samaritans or similar if you are feeling low. Do give them, or a trusted friend or family member, a cal if you need to talk?

ive suffered such alot in my life especially as a child, abuse isnt nice...now they are abusing me in my adult life...what and who gives them the right to treat anyone like that...do they not understand what they are doing to me mentally... are they trying to drive me into a deep deep depression again..

No, they will not understand that unless you have told them all your past history etc etc etc - their acts would not cause a different person to react like you react.

 

I think you need someone to talk to now. Can you go back to your GP? Do you have someone to call?

no. i dont have any family near me. they live abroad. i have told them about certain things that happened in my past. if i go back to my GP he will put me on the sick, and i will lose my pay..we only get SSP when we are off....if they know about my past history, then why do this...they must know how dangerous thier behaviour is to some one like me..

im sure i can put a claim in for the mental stress and psycological affect this suspension is causing me. if a company does this to an employee, im sure thier are grounds in the employment law against such acts..and compensation can be sought after. i have contacted a no win no fee lawyer, just waiting for them to get back to me..

Not unless you can prove they were negligent. Given that suspension is a neutral act, such a claim is unlikely.

 

I would echo the need for a GP visit though.

they have a medical report from my doctor. and it does mention alot of things including stress related times. i filled the gaps in with a txt message to my regional accounts manager who is dealing with me, i know that wasnt a good act to do, but i was so low and extremely distraught, and the people who were bullying, i felt were getting off scot free..

Ok, just to put you in the picture I was suspended for nearly 2 months and that was without Christmas. If you see your gp there is no reason to be signed off as unfit for work as you are not working. What i think you need is some mental health intervention. I am on anti depressents as well as tranquilisers beta blockers and sleeping pills as well as seeing a therapist. There is no shame in needing help. To be honest that is all i can help you with right now. Sorry but

well, still waiting for an outcome from this so called suspension. i noticed that the person who suspended me went from- regional support manager to regional accounts manager three days after i was suspended. have emails to prove it. i bet she had to show herself to be someone to gain this promotion, and used my suspension to get it..ive heard of nasty thngs being done to people, but this takes the limit....what you guys think...? all i want to do is work, and make a better life for myself, not be treated with such disgust and my name blackened...and i bet they are waiting for me to leave, and will go so out there way to make my life hell if i dont...by not paying me and causing me extreme upset....how can companies get away with doing this to decent human beings..

I think you are talking like a stressed and slightly paranoid woman and need to go back to your doctor. Please do. This may go on for several more weeks and I think you need support.

thanks..im going slightly over the top, i know i am. working in the business that i work, has this effect..as just about all my colleagues in my work place are just as paranoid as i am.. i dont want to end up in the same boat..i dont want to drown like they are, i hate negitive thinking people..its the no contact from them, no updates nothing. its the kinda thing they do all the time to everyone...to be honest it aint a nice place to work...

Princess I know how it feels when you're off work and you have no contact from your work or work colleagues. It makes you feel like you are unimportant or unworthy. But truth is whilst you are away from the workplace, like for them goes on and it's business as usual. Don't take it as a sign of something sinister or a vendetta against you. Use the time off to get yourself together, exercise, relax, walk see your doctor/therapist. Spring clean, anything to keep you busy. What you have to do is resist writing your thoughts and fears out and letting your work see them. I feel you have through a terrible time, but use this time now to gather your strength and get well x

You sound as if you have a job with a lot of responsibilty, well done.

If this woman was promoted or had her job title changed 3 days after your suspension i can guarantee they are not connected. The way you describe it you work for a rather large company. I used to work for a leading food manufacturer and believe me,they knew months in advance what was happening.

Any opinion I give is from personal experience .
