      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I wouldnt believe McVey at all.

It could be just a calming measure to cool things down but they will still carry on at the same rate.

Perhaps they're hoping all those with indefinite and lifetime awards of DLA will vote Tory cause they still have their benefit. Or they think that we think if we all vote for them again they'll let us keep it. After all Nu Labour were making noises about DLA and looking into reassessing Life awards (after all it was on their watch that for life changed to indefinite).

Trouble is a lot of those on lifetime awards will think they've let them keep it and vote the Nasty Party back in. Even those that keep their Motability cars are not going to have the choice they do now.

 

It will go back to how it was when it started; if you want anything more than a basic 2 door car with rubber mats you'll have to make a heavy down payment. Back then I had to make a down payment on a 4 door Metro, it would have costs £100s to have it with metallic paint, and a basic (rubber mats, wind down windows, 2 doors) VW Polo carried a £1500 premium.

 

PIP will decimate the UK car industry and ruin the Motability scheme.

Neither party is going to change anything. The hard, nasty work has been done by setting up ESA and PIP so the next Government will simply let it run as the worst will be over

What's the difference between lifetime and indefinite awards?

 

Indefinite means it has no fixed termination date but could be changed at any time, generlly designated to people who's condition might or could improve.

Lifetime means its for life, and generally given to people with degenerative conditions where there is no chance of improvement.

I was on one of the disabled groups the government consulted on change from DLA to PIP and changes will happen, All political parties agree on that....

I don't think anyone's against DLA being reform. The problem is the way the government is going about all this. Yes, the criteria does need to be changed to reflect society today. But PIP makes no sense - there's no supervision (lack of can be dangerous) and it's based on points. Some people with severe disabilities are going to lose out. But their needs haven't changed.

The main issues with PIP for me, are the change in mobility criteria, the lack of considering supervision needs, and the use of ATOS for medicals. I think for some it will actually be beneficial - but only if they can get through the medical assessment. I'm not sure if I would agree DLA is easy to claim, but there are ways of abusing the system - but that will be the same with PIP. I like the fact of having descriptors, as I think this makes the system more transparent and easier to understand, but then again my mind is drawn back to who will be assessing those descriptors and how. I felt that ESA sounded like a really good idea when it was first suggested - helping sick and disabled people into jobs they can actually do, and giving priority access to treatments, training and support. But that is not what it turned into, it was just a way to reduce numbers claiming. I do worry that PIP will be like this - a good idea that will just be used not to help, but to slash the benefits bill - and evidence of this can already be seen with the changes to the mobility descriptors.

 

Sadly politics seems to be moving to the right, which limits who I could vote for. I worry about why it has moved to the right, in that a right wing philosophy favours the rich, corporations, business owners etc, and there appears to have been a concerted effort in the media to influence the political leanings of the populace towards the right with the use of propoganda, misinformation, and heavy bias. Also the encouragement of an americanised 'aspiration culture', where many want to be (and believes they will one day be) rich, famous or important, means many have an eye to protecting their own imagined 'future wealth', and that somehow this 'future wealth' is at risk from the perceived evils of the time - immigrants, benefit claimants, europe etc. and these evils are what is holding them back from realising their aspirations. Many have lost the ability to empathise with the diverse situations of others who are less well off, and selfishness and greed abounds.

 

I think we need a new left wing party, otherwise I think many of us will feel unable to vote.

Yes, I'm still hoping it was some sort of weird joke - because the idea of lots of people thinking the BNP is a legitimate (even left wing!!) alternative, simply horrifies me.

Back on track

If someone hits 63 this year, and they wont be reassessed for PIP untill 2015 they will then be too old to claim PIP and be dumped off of it. See the sly little trick McVey has pulled?

Lots of people think "Hey cool we wont be re-assessed untill 2015" now giving a lot of people an idea of a respite, But they dont realise they wont be allowed to claim PIP as they will be over 65 and will lose their DLA when they are 65 so they get....................NOTHING

I bet the pill given to sweeten things will be an easy ride onto Attendance allowance but that still means those of us on Highest rate Mobility and Care will lose £200 a month

They won't lose their DLA when they reach 65. If you received DLA before you reach 65, you receive after 65 as long as you meet the criteria.

 

I dont think you understand. Heres the criteria:

 

The personal independence payment will replace the disability living allowance for eligible working age people aged 16 to 64 when PIP starts

 

I will be 62 in April 2013 when re-assessment starts

The good news are not good news at all.

 

In reality, the Condems are carrying on exactly as intended, with the trial rolling out of PIP starting in April as planned, countrywide rollout in sept/Oct as planned and gradually reassessing everyone.

 

It was never going to be an all out rollout all at once, it is logistically impossible to reassess 500 000 people at once, and to cater fro all the new claims too. What the government hadn't done was tell us how they were going to proceed, and this is exactly the way I had predicted it would happen: 1st people who are coming to the end of their existing award, then the longer awards and finally the indefinite/life awards (which are the same thing, btw, just a change in terminology), hoping some of them will have popped their clogs before that anyway. It also gives them maneuvering room to see how the implementation is going, especially when it comes to tribunals, as they know that indefinite awards taken away are much more likely to succeed at appeal, so no point in clogging up the appeals system (even more) straight away). Also, if, as expected, they get kicked off at the next election, it's rather neatly leaving the next government to handle this particular hot potato, which is going to be hugely politically loaded. If it's proving too hot to handle, they can then drop the re-assessment for indefinite award, pretending to be caring and having listened to the people, bla bla bla... Either way, they have all to gain and nothing to lose by doing it this way.
