How long do creditors take to default usually?

After having a look at my options I've decided to let my creditors default my accounts and then come to some sort of arrangement to pay.

 

I have catalogue,

store card,

PDLs and

credit cards.

 

I'm wondering how long it usually takes for them to actually default you?

I want to get things sorted but definitely want my credit file recorded with those defaults first so that the 6 years start ASAP.

Are you still making the minimum payments ? If so then they are unlikely to default you until at the very earliest.. 2 - 3 months after missing the first payment.

 

If you let your creditors know you are struggling to make contractual payments - chances are they will default you immediately.

The length of time to default will depend on the creditors inhouse rules, the ICO states defaults should be placed within 6 months of the cause of action.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

I thought if you make a payment arrangement they just put AP on file without defaulting you? ....

.or are you saying I should just tell them I can't pay right now (without making an arrangement) and then wait for them to default me before I offer any payments?

 

Brigadier - Okay, so 'the cause of action' being non payment yes?

The cause of action by definition is when a payment is due and not made after which no further payment is ever made, or when the creditor decides there has been an irretrievable breakdown between them and the debtor.

Hi guys would really appreciate a bit further info regarding my previous question in response to Citizenb as above.....

Havnt made ANY payments to anyone lately but some are only just becoming late/recently missed so just wondering what to do...wait for a default letter or notify them...will they then default me if I tell them Im struggling?...

IMHO, I would prepare your budget so you know what your disposable income is.

 

Then write to all your non secured and low priority creditors and tell them you are struggling to maintain contractual payments. You would like them to consider your financial hardship and accept £x amount for a period of between 6 - 12 months when you will be able to review your situation and contact them again. Your offer is dependant upon them freezing interest and not applying default charges to the account.

Ok, I will do that......do you expect they will then 'default' me on file or would this not then be seen as an 'arrangement to pay' ? This is my concern...I would rather have the default registered as soon as I can rather than an AP as obviously the default dissappears 6 years from it being applied whereas the AP will only dissappear 6 years after it is satisfied.

Ah right, I see where you are going with this.

 

TBH, I really dont know - I know from experience that

 

Tesco will automatically default you if you enter into a payment plan

Capone will string it out as long as they can to add maximum charges

I really dont know about other creditors.

 

PayDayLoan companies operate a different system as far as I am aware and I understand that Credit reference agencies are going to recording these in a different manner. I am sure there was an article about that a few days ago. I will try and find it.

 

What companies are you dealing with !

Capitalone- my husbands credit card

Littlewoods online account

Next online account

Aqua credit card

B&Q store card- owned by HFC finance ..I think.....not quite sure but can find out..

WONGA- have emailed these awaiting response..

Very onine account

and my dear old granny has just paid off my doorstep loan....:whoo:bless her..will pay her back when Im able to.

Right, well apparently only 2 of the Credit reference agencies at the present record PayDayloans - Experian is soon to do this.

 

Having a look round the PDL forums, it seems they do register defaults I would think that these are registered fairly quickly as PDLs are short term loans.
