Vanquis Bank Help Please!!!

I am fairly new to this forum,

 

I am having major hassles and stress with the Vanquis Bank. I have an outstanding balance of £1798.64 with an arrears amount of £124.77.

 

I have sent them an incomings and outgoings statement as well as an offer to pay around £34 a month.

 

They refused the first letter I sent and instead offered me £50 a month.

I declined and sent a second letter (template I found on here) and this morning got a letter again saying I must contact them by phone.

 

I refuse to do this is I have a complaint with the ombudsman service already about their continual phone harrasment.

 

Now I just dont know where to turn.

 

I am fast losing patience any suggestions would be greatly appreciated!

Vanquis are no better than a Pay Day Loan company, sadly..

IMHO, you should simply write back something along the following lines.

Dear Sir/ Madam (or named person)

I am in receipt of your letter dated XYZ.

Having provided you with an income and expenditure form which quite clearly advises the state of my finances, I am rather disappointed that you appear

unable or unwilling to accept the offer made.

You are being treated to the same proportion/percentage of my disposable income as other creditors and to give you more, would mean someone else getting less.

 

My I&E is based on the same system a Debt Management Company or even the court would use therefore your request to prioritise my debt to you would simply be wrong.

I am also extremely concerned at the increased pressure for me to telephone you and I would ask you to place on record that it has been my policy for some time now to only communicate in writing when dealing with my financial affairs from my home,

as it is my right to do so under Article 8 of the European Convention on Human Rights.

This also ensures an accurate record of what has been said whereas if I were to telephone you, there would not be. Therefore I will not be telephoning you.

I do hope that you will be able to revisit your decision and look forward to your acceptance of the offer made.

Thats the letter I sent to them after they refused the first offer. I got one back today that says "We have been unable to contact you by telephone to discuss your fixed payment arrangement offer for you vanquis credit account. Please contact us immediately on blah blah to discuss this matter. Interest and charges may continue to be applied until any agreement is reached. If we do not hear from you within 14 days of the date of this letter, we will assume that you no longer require a payment arrangement and are able to meet the required minimum monthly repayments to your account."

 

They know I refuse to talk to them on the phone, as their phone operators know absolutely nothing about anything!

have a read of a few threads

 

if you want help with the letters

 

here is an example

 

TELL [dont ask] them they are only going to get £xxPCM for xx mts

as a goodwill gesture

and as a reciprocal GOGW they must freeze int & refrain from levying PENALTY charges.

if they wont

drop them to £1PCM for life.

as an example>

I am currently in financial difficulties and not able to meet my normal monthly repayments.

to show my goodwill, i am going to pay £5 for 6 mts.

 

i will update you in 6mts time or before, should my situation change.

.

could you please as a reciprocal goodwill guesture,

.

refrain from levying any penalty charges & freeze the interest on my account.?

.

Should you fail to assist me during a period of financial difficulty, contrary to all the guidelines and codes

issued by the relevent bodies and authorities that govern you and the way you conduct yourselves.

should you fail to help by refraining from levying unlawful PENALTY charges & freeze my interest,

i shall have no alternative but to reduce my offer to £1PCM for the rest of the life of the account,

as your actions are doing nothing to help me.

This is contrary to the rules you should operate under.

Yes, I am accruing late payment and over limit charges. Thanks for the advice, I have sent the suggested letter and will await an outcome.
