Hello,

just 2 quick questions that I hope you can help me with.

 

I had a mobile broadband and contract phone with three in 2007.

When the 18 month contract ended I didn't renew my contract.

 

I've just got some letters from Lowells acting on behalf of lowells at my new address

demanding money and threatening legal action.

 

Three must never have closed my accounts properly.

I have been tempted to ignore them but reading on here how they can try to make you bankrupt.

 

I have no assets, I am living in rented accommodation and moved not long after cancelling my contract with three.

The defaulted amount is 69 & 94 but with the cancellation fees these have risen to roughly around £380 each.

 

I have read that the amount they can put in for SD is £750 but together these 2 accounts do come to that.

 

Sorry for the waffle but my actual questions are:

 

1) Can they make me bankrupt by joining both accounts together?

ans

2) If not bankruptcy can they apply for a CCJ?

Hi dx, thank you for your quick reply.

 

I have checked my credit file there are 2 defaults for the above amounts,

i got the free one from Noddle and I'm assuming it would be on all the others too.

 

The letters they send out really do scare you..

I will ignore them for now and enjoy my Christmas!!

just remember

 

they are a DCA

 

they are NOT BAILIFF

and have NO such legal powers.

 

the dates of the defaults will prob be close to 6yrs

which is why they are chancing their arm.

Totally ignore them.

 

I cancelled my contract with three in writing via their online system which doesnt send u a copy of what u have written.

 

They then denied i had cancelled my contracts and tried to claim £40ish in fees for both accounts.

 

Nothing they can do.

 

Enjoy christmas and enjoy them both becoming statue barred ;)

The misconception from the OP is that the contract ends,

it rolls on a month by month basis until cancelled,

 

however the "fees" would be hard to persuade a judge that they are reasonable IMHO,

so keep this on the back burner, keep all correspondance they send (AKA threat-o-gramslink31.gif)

and if they do try to take this to court, update this thread.

 

Leon,

they do report on your credit file,

so it may be worth you checking that out.

If in doubt, contact a qualified insured legal professional (or my wife... she knows EVERYTHING)

Thanks for the replies.

 

My contract ran out and I didn't renew it.

 

I do recall having a conversation about upgrades but didn't go for it as the phone I wanted wasn't available

 

told them I wouldn't be upgrading.

 

I got another phone through T Mobile with broadband for my laptop and have had that ever since.

 

I have since read that a phone-call to say you won't be upgrading isn't enough and this must be followed up with a letter; which I didn't do.

 

I am annoyed that they have added these defaults considering they're for something I never wanted or signed up for.

And reading here about Lowell, I doubt they would remove the defaults anyway.

 

I won't be getting a mortgage any time soon and generally save and use what I earn instead of getting credit so I'm not that bothered.

 

It must be hard for people that do want a mortgage and I think it's out of order for companies to just add on these defaults which can mess a person up for 6 years!!

 

Anyway Christmas hangover rant over!! And Locutus: I will update the thread if I do get any more threatening letters.

Hi, I was told to update the thread if I received any correspondence re. them taking it to court.

I haven't received anything as such but have now started to receive letters from Fredrickson International??

 

I wasn't aware they were the same as Lowell,

I know Lowell work under many different guises but Fredrickson too?

 

The letter I got was a 'pay now or further proceedings will start'

 

but just yesterday received a bright yellow postcard with Fredrickson stating that my address is a 'confirmed' address

and I will have to pay ASAP otherwise legal proceedings will start.

 

This is for only one of the accounts not both.

 

Again, I know they send threat-o-grams but this has worried me slightly...

can I get a CCJ for this?

 

Before all the fee's I'm pretty sure Lowell stated the original bill was £70+ not £300+

 

Can you get a CCJ for a bill of £70?

freddies are a DCA they dont own the debt

so can do nowt

 

as for the yellow card

 

read it properly, it does not say WILL

Yes you are right, it does say pay 'or your account may be passed to solicitors to consider legal enforcement'
