A very quick update since I'm supposed to be swatting!!!!

 

Produced 2 of the documents from the Competition Commissioner's report into Banking in Northern Ireland and filed them in Court / copy to Halifax on Monday morning.

 

For those who don't know about this report (only published on 20.10.06) it's quite a 'smoking gun' and makes many references to profiteering from charges and a lack of actual costing of the whole default scenario by banks - the Halifax being one. Since they took part in the investigation, they can hardly have a case for denying me the right to use it now!

 

Let's hope the Judge agrees......

Appendix 4.6 pages 18 through to 28...........Very interesting reading. Shame so much has been censored but still could be quite damming.

 

I seem to recall from the citicards thread of lickthewall that it was agreed that UK, NI and Scot could all be treated independently due to differring levels of expendature and costs etc, so I can see a get-out-clause coming in terms of court admission?

 

Don't suppose an equivalent report has been compiled in the UK?

That would be too easy I guess.

This report specifically states that the Halifax (amongst others) base their charges etc on their operations throughout the UK.

 

If any bank suggests differently, you would need to ask what specifically is so different in relation to their costs that would mean it needed to alter charges accordingly.

 

They have no get out clause as far as I can see (again, let's hope the Judge agrees!!)

09/10/06:Halifax claims opened with prelims

claim 1 = 1392.38

claim 2 = 1437.74

claim 3 = 1480.76

claim 4 = 0185.32

Changed tactics.

1 claim of £4600 submitted - will travel to england to go to court if required.

 

27/10/06: LBA sent

01/11/06: Recieved an offer of £764

05/11/06: Refusal of offer sent

11.11.06: MCOL submitted

13.11.06: MCOL issued

16.11.06: MCOL aknowledged

17.11.06: recieved withdrawal of offer letter - too late, it's already with court!

27.11.06: recieved written confirmation from Northampton County Court. Still no correspondance from Halifax. They have until 15/12/06 to respond.

O1/12/06: Settled in full, including interest.

Good Luck tomorrow! I'm currently preparing to do a similar thing to the Halifax myself -

 

- Removal of Default

- Distress and Damages

- Additional damages due to deterioration of health - Stress makes my muscular condition worsen

 

Don't want to say any more - it's a bit sensitive at the moment....will let you know of progress

 

Would love to sit in on your case though, it looks like you've got it well prepared - that and I only live five minutes away from Mansfield County Court!!!

 

Anyhoo...bloody good luck - give 'em a thrashing!!!!

Maybe he's on the Black Russians already. He did say he would be celebrating before he let us know, so if it's a real bender we may need to wait a couple of days.;)
