Although I know we are all waiting on this but as with Whiz it may be that there are things that cannot be released today by Jonni because of legalities.

We should be aware of this as it looks like there will be some serious implications here either way.

There is only 1 result we want to hear tho......................

Nothing spectacular to add, although I have now written a very stern letter of complaint to the judge about the litigation behaviour of the bank and their solicitor, making sure it got in there at 10am, just in case...

I have outlined the fact that they were fully aware my claim was in two parts, so telling the court they had settled in full was clearly incorrect, and that in 2 telephone conversations I had denied their request for an extension, so their fax to the court was clearly a misrepresentation of the facts.

It's time to wait and see now, the judge might still have granted an extension, if he/she believes there is cause. But, I think if that happened, I would already have some advantage because of their most recent actions.

Fingers crossed....

An amazing read Jonni...........well done so far for your perserverance and good luck with hopefully the final chapter!!

It beggars belief what these people think they can get away with, it is even more amazing their lawyers seem to think they can also get away with all sorts of underhand and deceiving actions.

Defence received and, to be honest, it's all very familiar and contains nothing new that would excite anyone.

They basically state that their charges did not cause the default. They don't appear to have given it much thought really.

I also served a Sction 10 Notice a few weeks ago, and their response to that was also very templated, much to my amusement.

A response to their defence will be returned with the AQ, which must be done by 17th.

  • 2 weeks later...

Wow! Only recently stumbled across consumeractiongroup.co.uk, and am at the beginning of what looks like an interesting journey! Having printed off lots of posts (thanks to Imported,Bank Fodder), im just trying to get my head around everything, I want to be fully prep'd at every stage..

Just wanted to say my hearts been racing reading Jonni2bads progressive posts and actually seeing the objectives are achieved.

Once I get going I hope to have several thousand pounds re-imbused, starting with barclays..then barclaycard...then goldfish.....the capital one.....LOL.

And whats good is I already feel like theres a supportive community to help me on my way!

Thanks. Waveblaster!
