Snotcrawl ffor lowells on old O2 debt of sons - help

Roughly 3-4 years ago, my son (then 18) took out a fixed term contract with O2.

 

He struggled to pay every month and was cut off on a couple of occasions,

only having the connection restored once I'd paid his bill for him.

 

When it happened for a third time, even after I paid his bill (or more accurately, loaned him the money by making the payment myself),

they didn't reconnect him.

 

After a couple of calls with the O2 "help" desk, he told them verbally that since they hadn't reconnected him,

he was cancelling the contract as they weren't providing the service for which we'd paid.

 

Stupidly he put nothing in writing despite my advice.

 

Of course, after some time, O2 came after him for payment of the outstanding term of the contract;

he refused to pay, simply ignoring their letters.

 

They gradually increased the amount due up to a ridiculous total (£700+) by adding spurious "admin" charges etc. and threatened bailiffs etc.

 

He did then send them a letter (which I wrote but in his name) pointing out that it wasn't his fault they'd not reconnected him,

and also that he has no bank account or funds with which to pay.

 

We did offer a goodwill gesture of £100 on the basis that they fixed his credit rating.

Everything then went quiet for ages until he got a letter implying they'd dropped the claim.

 

However, he then started getting letters from Lowells whom we presume had purchased the debt from O2.

He's been ignoring their letters too although the most recent one has worried my wife and I because, now that he's living back with us

and they're getting more threatening, we don't want debt collectors turning up at our house.

I wish he'd kept the paperwork but he hasn't.

 

He also has a "can't pay, shouldn't have to pay cos its O2's fault"

attitude and feels they're bullying him (which I agree with).

 

The amount Lowells are claiming is £447 and they've given a deadline of 3rd Jan before they pas it to ScotCall.

 

Any advice please?

snotcrawl can threaten all they like

 

they SRE NOT BAILIFFS

 

they have NO SUCH LEGAL POWERS..

 

if some muppet turns up at your door

 

tell them to leave and call the police.

 

if O2 wanted theirmoney they would have done something years ago.

 

best bet is to stay off the phone

 

you/son are under NO LEGAL OBL to discuss debts that way

 

might be an idea to get his CRA file

 

it could well be trashed.

Scott - thx for the thread

 

Dx - thx for the advice. I'm a newbie at all this (as you can probably tell). Assuming CRA is Credit Reference Agency, how does he get his file, what's the point of getting it, and what can he do if it's "trashed"?

 

Should he just keep ignoring the Lowell/ ScotCall letters?
