    • There's a thread somewhere about someone sending the baillifs against Wizzair that is quite hilarious. I would love to see someone do the same to Ryanair. Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Has anybody else experienced this?

I firmly believe my bank HSBC, are discriminating against me because of my use of Betting organisations

- cash comes in and cash goes out regularly.

I'm almost certain they "down score" my/your credit rating internally but it's hard to prove if they do this externally.

I tried to "pin down" a bank employee in a financial review, when I was refused an extension to an overdraft.

All I got was "erm...because of the nature of your entries"???

Nature of my entries?

Surely this is not allowed?

What is my/our legal standing?

Does anyone know who you can obtain written answers from within the banking fraternity?

Anybody got similar experiences or any advice?

Sent my letter 13.07.06 and got this response today...

Dear Mr.........

Your reference 12345678

Thank you for your letter dated 18 July 2006 concerning the recent circumstances on your account.

I am looking into the matters you have raised and will contact you with a full response as soon as I have completed my investigations.

In the meantime, I enclose a copy of our leaftlet. blah, blah, blah

Yours sincerely Mr HSBC man

Customer Service Officer

So what do I do now?-bricking it slightly. Is this a general fob of letter? Anyone else had this as their first reply?

I see they have twisted the date of my letter-probably putting when it landed on their desk.

Do I hang fire and wait till the 28th July-then if no response send the next stage letter?

I take it stage two is LBA?

Can someone comfort me lol;) Does anything happen between this initial fob-off letter and the next so many days?

21st July- Bad news.

Got a letter today from Customer Credit services in Sheffield and numerous leaflets on t&c's.

The give me a three page spin on why there charges are justified blah blah blah and that they see no reason to refund me.

At the end of the letter it says

FULL RESPONSE

We hope that you will be entirely happy with the attached response and as a consequence your complaint can now be considered resolved.

Then there is an address to write to if you wish to escalate the complaint further:

HSBC Bank plc

Service Quality Team

Leeds

So what is my next step please? Anyone else had this letter? Do I now send my letter before action letter to Leeds?
