Hi, first time on here so please be kind!...

 

..i have a number of credit card debts due to being made redundant 4 years ago,

at the time i offered a token payment to all of them as i wasnt earning of £1, which was accepted,

 

since then i havnt been back in touch with them ( avoided really) and burried my head in the sand to be honest!

 

i currently have them chasing me again and just dont know where to start?

 

i have heard that because i never physically sighned an aggreement with them that they arnt enforceable?

 

any advice would be very helpfull?

thanks for the advice, will talk to national debt line! if the cards were taken out before 2005 are the enforceable?

 

Send a CCA request to each of the creditors - this is a request for a copy of the agreement.

 

It will cost you £1.00 for each request and the company has 12 working days + 2 to comply.

 

They are obliged to provide you with..

 

A copy of or truthful reconstruct of the agreement

Terms and conditions at time of entering into the agreement and also at default.

Plus a statement of account.

 

If they dont provide this, then they are in breach of an s78 request.

 

There are no sanctions for non compliance now however, should anyone then take steps to issue a claim, chances are you would be able to use the non compliance in any defence.

 

If the agreements were taken out before 2007 then you have greater protection.
