I got a car from one of those nasty car places, purchased via Bill of Sale, car was worth around £3.5k,

 

to cut to the chase, I got a new job with company car and as I was struggling with repayments

 

i tried to voluntary return it... They repossed it, and took me to court and I got saddled with a shocking £17k charge.

 

They put a charge on my house, and as I told them at the time my house was in negative equity so if I did ever sell they wouldnt get the money.

 

Its now 6 years and I not paid a penny or had any contact since,

 

what can I do ??

Morning,

 

As above the CCJ does not technically expire but will come under the statute Barred guidelines, if the company or Solicitor who obtained the CCJ against you wishes to have it re-instated, they would have to return to Court and have one hell of an almighty excuse as to why they had not collected.

 

The Charging Order will stay until you either sell, give up the property or if it is for a tasty amount then they go to Court and force you to sell which does not appear to be the case.

wasm't the funding corp was it?

 

have you still got the paperwork for the sale

 

as many BOS's were defective?

 

could blow the whole thing out the water.

 

you need to urgently get an SAR off to the OC

 

in case they distroy it after 6yrs.

 

something is very wrong with the figures.

Lol how you guess it was Funding Corporation !!!

 

At the time, I didnt challenge anything, had a solicitors look into it they mentioned a few things but then i failed to get legal aid to cover the money they wanted to fight it and so it was dropped like a stone.

 

Anyone know if it can be relooked at even if its been to court.

I have all the paper work from day one, as the car after I bought it back with them for 5 weeks as it was defective..

 

. Other thing I noticed reading up on it was that obvs they sold they old insurance and also said I had to have the car cover too,

but after having it for 6 weeks the cambelt went and as the car had over 100k on the clock the insurance was half the price..

 

. If you knew nowdays what we know now with the power of this site etc, it would never of gone to court..

opps so the car was faulty within the warranty

 

you need to do you homework

 

i cant see why the whole thing could not be over turned.
