discrimination claim against DR+

I have got fed up with playing letter tennis with Debt Recovery Plus so intend to turn the tables on them and send them a letter of intent regarding legal action for harassment. I will also include a statutory questionnaire for discrimination under the Equalities Act for disability discrimination as they have not made necessary adjustments to their systems and methods of harassing people who dont owe them money to take into account that as a mentally ill person the amount I am distressed by them.

Just want to know if anyone else has done this (I know about the famous British Gas case but that is not under the Eq A) and can offer wording for the covering letter and whether S19-20 (discrimination)or S26 (harassment) is more appropriate.

You could also ask them for a complete breakdown of the supposed "losses" suffered by the landowner, while reminding them that they must not confuse day-to-day running costs of the PPC with the supposed loss suffered by the landowner. The reason I make that point is that PPCs in the past have tried to include the cost of the parking attendant's uniform or the maintenance of their signs as part of the loss.

Dont worry, I have a better reason for not paying the original parking control company- I am the landlord. Havent told Debt Recovery Plus that yet, thought I would save it up for when I put a defence in should they actually issue a County Court summons.

I thought I would point out that I own a property company that owns a block of buildings that have retail on the ground floor and flats above. there are parking spaces to the rear. One of the shops is leased to a well known supermarket chain and they took it upon themselves to employ a parking control company to manage their spaces. I used to get a lot of jun mail from companies offering to solve my parking problems for me but wouldnt give any of them the time of day. I found that the best way of getting results was to ask people not to park there again. There are other measures land owners can use if there is a genuine problem but parking companies are the lazy option. However, there are tax advantages for using PPC's if you are a large corporation, university or hospital. The latter would suffer very badly if they charged for parking directly, they would have to pay Corporation tax and lose their charitable status tax breaks.

You raise an interesting point, for which I thank you, that I had not previously considered namely Corporation Tax. My knowledge of that matter can best be described as - a lack of. Despite that lack I have suspicion that where the PPC is acting as Agent, as is the case in a large number of instances, that wriggling through Corporation Tax will be not be simple nor be guaranteed. This is in line with my thoughts on the matter that when the PPC acts as Agent the monies never touch the Principal's accounts which I believe may not be correct. Do we have any Accountants who could comment ?
