Dear All

 

I recently wrote to HSBC reclaiming missold PPI for a loan and credit card I took out between 8-10 years ago, the accounts of which have long since closed.

 

They acknowledged my letter and sent me one of those Ombudsman standard forms to complete but not having the original loan and credit card agreements anymore, I wrote back stating that I was unable to complete the form with any accuracy. I asked for a copy of the agreements from HSBC; they have now written back and told me these cannot be located.

 

Before I had a chance to write back, another letter arrived from HSBC stating that as I had not completed the Ombudsman standard form, they cannot continue with my claim without it as this would have helped them to understand why I thought I had been missold PPI.

 

Is the onus on me to prove that I had been missold PPI or is this a delaying tactic. Any advice as to next steps would be welcomed with open arms.

you atleast need the agreements

at best the statements

 

an SAR might be your best bet

 

but just remember

 

a creditor has no legal need to hold any data held on accounts closed since 6yrs of its closure

Thanks for your response, much appreciated.

 

What I don't understand though is that in their return correspondence to me, they quote the loan agreement and credit card number as the subject so they must have some record of me somewhere so why say the documents that I requested cannot be located.

 

Given this, do you still think an SAR is the best bet or should I just say why I think PPI was missold to me?

 

I'm not even sure that I can still claim missold PPI given that the age of my closed accounts (8-10 years)

 

Having read similar posts on here, there are some success stories by people just making telephone calls.

The results for the folk just making a phone call are fine if people don't want to check that their award is correct. Remember, never trust a bank!

 

Doesn't matter that you r loan is 8-10 years old, if data exists you could still have a valid claim if the PPI was mis-sold.

 

If it were me I would try a SAR and see what comes back.

Happy to go down the SAR route but given the bank has told me in an earlier letter that the documents cannot be located, is it worth it?
