Hi I'm new to this forum but really need some advice as I've recently split up with my patner and moved in with my parents I only went back to work In October after maternity leave and called tax credit to change circumstance and Childcare provider plus my working hours.

 

but that was on the joint claim as I was with my patner at the time then within a week I had problems with the Childcare provider and had to change so I called up tax credits and changed provider within a week the cost and all was same then after 3 weeks I found a better payed job in a nursery which was also offering my discount on Childcare.

 

so I took up the job and rang tax credits again to change work and Childcare PKU Childcare cost had reduced but I didnt tell them that I moved address because I moved out in the 7th of November as my patner was cheating but I really did think wr would work through it but on the 30th of November I went to my patners to pick up some if baby's stuff and realised he had someone else living with him (talk about a shock!).

 

so I then decided I was so done with him and ask my parents if I could stay for a few months until I find my feet n they agreed I then rang tax credits and bank a few days later to change address and told tax credits we tad split the lady on the phone was extremely rude pit me on hold for 20 mins and then told me she had put my new claim in and ended joint claim and it could take 3 weeks.

 

I then asked if it would defiantly be done in 3 weeks as I have no money because the nursery I work for deduct Childcare from my wages and I have £78 left after Childcare for the whole month! She said it should be processed.

 

I then got a letter on the 3rd of dec saying joint claim ended and I owed them money when I called I was told my previous claim and new claim is with compliance team and they have sent me a letter wich could take upto 3 weeks to get to me and I xant do anything until I e received the letter!

 

I have no idea why compliance would write to me as I've been constantly updating info and everything I've told them is 100% true.

 

I now have NO money and a baby under 1 to feed plus have to pay board to my parents my ex is a waste of space and will not give anything! Not even the stuff that's still in his house. And advice would be much appreciated sorry this is so long

I'm sorry this has happened to you. Unfortunately a percentage of claims end up with the compliance team at random and they do full checks on all documentation - sadly this does delay the claim. All you can do is get all the paperwork they ask for to them ASAP. I've seen this a few times and there really is no way round it - you just have to give them what they ask for.

What will they ask for? And is there no way I can get the number for the specialist team without that letter? I'm in such a mess right now it's so unfair that the people who respect the system are the ones struggling

Birth certificates for you and the children. Proof of immigration status if not British. Proof of address. Proof of childcare arrangements and costs. Proof of any benefits being received (child benefit). Bankstatements. Proof of wages and hours of work. That's off of the top of my head, there may be a few more things according to your circumstances.

So you didn't end the joint claim until the 30th November but you moved out on the 7th November? Is that correct? If so then Tax Credits will take the 7th November as the date your joint claim should have ended.

 

As for the CSA I honestly don't know if they will see the mortgage as his contribution. Ring them up and get a claim started

That's right I didnt end the claim till 30/ November but I did try tO explain myself. I'll get in touch with CSA first thing on Monday, sorry about the typos on iPhone here. Has anyone been I'm a situation like this

I wouldn't worry too much about the date of notification, you have 30 days to notify changes of circs to tax credits. Yes you may have money to pay back but it won't be taken from your new claim and your husband is also liable to repay. Once your claim is processed you can request backdating to the day after your joint claim ended, and use some of this money to repay your part of the overpayment.

The CSA, will not take the mortgage into comsideration, and will asses your claim

as a percentage, of your ex partners, income.

 

His morgage payments, will be taken into comsideration, as part pf the maritol asset, when you file for divorce.

However, the counter claim, would be you need to pay rent, and he's living there.

A solicitor, will get you through, all that ............. but for now, ring the CSA, with his details,.... where he works will help

 

Your baby needs feeding !!! .... he has to pay his share!

 

Do it 1st thing .... tomorrow!!

 

If it takes a while for the claim to be sorted ....... it will be backdated, to the 1st day of your claim.

i.e ...... tomorrow.
