    • Part of a settlement agreement.   concerbs over her nane online we’re raised and I was blamed for bad mouthing. I explained I put nothing up myself.  cannot discuss details of the case as per agreement.

    • Perfect, thanks Dave.   You're right, a whole dodo storm this has been. As sons of first-generation immigrant parents, whenever something like this happens the old man panics. There was a whole "appeal this now" because my dad paid for the parking as he was with the hirer at the time and he isn't as tech-savvy as my brother so he ended up doing what he did and because I don't live there anymore it came all the way down to this.  But yes, we'll do this SAR and see what comes of it.  Will keep posting here with the hopes that it may benefit someone in the future.  Thanks again, everyone.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi caggers

Need a little help with these bottom feeders. Recieved a phone call at work from these bottom feeders regarding an outstanding balance of £247.00. I phoned them to agree a discounted settlement figure as I did not agree with it being that much.

I got a settlement figure of £ 160 that I agreed to pay in two instalments and I requested that this be sent out in writing b4 i pay anything. The date of the first payment came and went and I paid nothing as I did not receive any letter of agreement from them. I then received a letter in the post stating legal action or a doorstep visit. I telephoned Advantis and advised them that no letter had been received and I repeated that if I did not receive a confirmation letter of our agreement, then no monies would be paid. The representitive said that it is not their practice to send out confirmation letters and refused to do so. He then put the phone down on me.

Any suggestions on my next move please

I am in much the same position with these idiots. They call and call, I have spoken to them a couple of times and the figure that we agreed on is fine, but they will not put it in writing, and say that it is their policy not to do so. So Am basically waiting now until either they change their policy or it gets passed on to someone else.

 

Before mine was with Advantis it was with Equidebt, who did actually send out an agreement in writing, but somehow they bounced it back to Txtloan and then onto Advantis the exact week that the first payment was due to be made. I wonder who it will go to next in the cycle?

Advantis do not often send out information in writing, more so because they cannot cope with the shear requests they receive.

 

Whereas I agree this is a poor policy, I would recommend you send the payment discussed along with a covering letter stating it is the first payment of an arrangement agreed with X agent on X date.

 

Put a clause in the letter that if they bank the cheque then its their acceptance of the agreement.

 

I would highly doubt that they would rescind on the arrangement on this basis.

 

Advantis also have limited capability to conduct visits. They receive commission on debt they collect, and therefore its not in their interest to lay out on this expense. They also have a limited time to get a payment on the account before it has to be sent to another DCA.

 

Send them an email at admin@advantiscredit.com asking for it in writing if your desperate.
