After reading this forum for quite some time, it spurred me on to reclaim charges from my bank, Northern Bank - a Northern Ireland based bank. I sent them the letter requesting statements. They sent them to me in a poorly packaged envelope a day or two shy of the 40 days. I will write the letter below as I have a couple of questions I'd like some help with, so bear with me with this lengthy thead.

 

 

 

So, my questions are as follows:

- Firstly, I do not recall ever getting their letter acknowledging me request.

- Are they required to disclose the information regarding all manual interventions on my account if I ask, or is what they say, actually true? If so, do I send another letter requesting it? They would now be over the 40 day limit.

- Where do I go from here? I reckon they owe be just shy of £700 over the last 2 years. Nothing charged before that so I dont need any of the older statements.

They do tend to respond with the paragraph around the manual intervention and to be honest it's quite rare to find an account where there has been manual intervention!

the choice is yours but if I was you I would now crack on with your claim as you have the statements... Go here:

Consumer Action Group > Libraries - bank charges materials and other issues > Bank Templates Library navbits_finallink.gif 2. Letter - Preliminary approach for repayment.

This will give you the template for the next letter - download it and then tweek to suit etc. Along with this you will need to attach a schedule of charges which is a spread sheet that you will also need to download and complete. Do not include the 8% at this stage this will only need to be added at the court claim stage there are a few different versions here one will suit:

I think that's all this stage. But another piece of advice is read, read and read it will certainly give you the confidence to carry on especially when you see so many successes.

fuuny how they can supply you with statements as far back as 1999,and they refuse to send me any prior to April 2004 due to "disproportionate" effort!!!

 

something stinks with the Northern big time.I've already beaten them once and I put in a claim for estimated charges prior to April 2004 as well....and they thought closing my account would sicken me.......tut tut!

Take them for all they've got! I went into my branch today for a couple of simple requests and the customer service I got was completely non-existant! No hello, no how can I help you, no eye contact, she didn't even look up from her computer screen! Just made me all the more determined to reclaim my charges.

 

I sent off the letter requesting a refund of all charges along with the excel spreadsheet detailing all the charges, which amounts to £643. They have 14 days!

 

It makes you all the more determined when you get arrogant staff doesn't it? I loathe the staff in Halifax. When I had my account they were unhelpful, rude and totally judgemental!! HSBC staff in my branch are lovely. So swings and roundabouts I'm afraid.

Yes Boobaby, found it very helpful. Got all my charges collated with the links you gave me, so thanks very much :)

 

I told a friend of mine about this just now and he's going to do the same thing to HSBC (Bank & Credit Card) and MBNA, he's all fired up after seeing this website!

 

I am completely and utterly hooked on this site my kids think I've lost my mind, I might as well send back my TV licence and as to a social life - this is it!!:grin:

It is a fab site though and as long as you are prepared to put in the work you will reap the rewards. It's not difficult, but can be time consuming as you have to ensure you get it right.

There are lots and lots of lovely, funny people that will help!! Some serious and some not so serious threads dealing with most issues believe you me. I've even made a few pals on here.:cool:

Go for it, but enjoy the process as well.

So today is the 14th day. 14 days ago today I sent off my claim. Should I send my LBA today, or should I wait a couple of days to allow for postage for the letter 2 weeks ago?

Allow two days from the day you posted your last letter for them to receive it bearing in mind that it is Royal Snail, then the 14 days for the response and then just carry right on with the process. They are stalling for time again!

It is fun isn't it, I know it sounds stupid but I don't want my claims to end, I am helping my sisters through theirs now - making them do the work but pointing them in the right direction.

put it this way-if you owed them £700,do you think they would let you off the hook for £300 odd?

 

 

It's your money-and as they are closing your account anyway,you don't owe them any favours

Okay, should I respond to the bank saying I am refusing their offer of a partial refund and will be proceeding through the small claims court?

There is a template letter that accepts the offer as partial settlement and states that basically you will be going after them for the rest. Well done you - you got 'em on the run:cool:

So if I send this letter off saying I will accept the offer of £224, but will be going after them for the rest, what do I claim from the Courts which I will also be filing today/tomorrow?

 

They owe me £700, minus the £224, so I then claim through the Courts £476 + 8%, is that correct?

 

What then happens if/when the bank cancels their offer of a £224 refund, which I am sure will happen when I tell them I am going after them for the rest? Can I re-add the £224 + 8% to my court claim after its been submitted to the court?

 

To be honest I would claim the full amount, then you have covered all bases. If in the meantime the bank pays £224 all well and good then they only have to pay the difference, but stick to your original plan and timetable and submit the claim for £700 + then the interest on the whole amount - you haven't had anything yet?:rolleyes:
