Barclaycard (was Egg) PPI Claim

I recently sent a SAR into Barclaycard as the starting point for a PPI claim.

 

I received a letter back with details that I had PPI on my account and returning my own letter and £10 cheque.

 

The letter noted (in summary) that my letter "was in relation to a claim for the sale of PPI" (my SAR letter made no reference to PPI) and that "this information is sufficient to enable... to progress a claim for PPI".

 

I writing back and sending the cheque back asking for full details to be supplied.

 

I couldn't help but notice though that the bottom of my original letter had been stamped with a large rubber stamp saying "PREQUAL". Does this suggest that they already believe I may have been mis-sold my PPI?

certainly write back - I would tell them they only have the 40 days from when the first letter was sent and if not complied with you are reprting them to ICO. Don't let them get away with this.

 

As for "PREQUAL" no idea, others may know.

Could mean "Pre Qualified" for investigation.

 

Certainly get back to them on the SAR. Ask them under what regulations they can decide what you want the SAR for and ask them to put in writing why they have decided not to comply with a request made under the Data Protction Act.

 

Ask them to put in writing why they have chosen to assume it was for a PPI reclaim.

 

Tell them that you want their written response so that it can form part of a complaint to the ICO or other action for non complaince that you may care to take.

 

Tell them that as far as you are concerned their attempts to frustrate the provisions of the DPA have no effect on the compliance time limit and that their 40 days is running from the date they received the initial request.
