    • Hi guys.   Ok - so since I was last here I have set up a new basic bank account, which my salary and priority dd's will come out of from March.   Just wanted an opinion on a couple of thoughts I've had -   1) I have just agreed with my mortgage provider a 3 month covid payment holiday, which will help for the short term - however, I have an overdraft is with this bank. Am I causing a problem if I contact them now about my financial situation, or should I leave it until the holiday ends?   2) My salary has recently come down, which is a contributing factor to my plight - However, my income over the last few months will not reflect this. On my budget sheet, I have put in the new ongoing i and e.  Is my bank likely to turn down my request of freezing interest etc. on this basis? They can see what has been coming in and going out. I'm concerned they'll think I've been creative with my income sheet?! Or can I simply refer to this new situation in the pro-rata letters?   Thanks again.   A  
    • Hello Taxhelper   Thanks again . Your so kind and Im very grateful.   I am about to submit the form in the next few hours. Before clicking the submit button there is a calculation page that has been generated by the site based on the info I provided ( income from PAYe and income from self employment etc...with all expenses deducted). their calcs are correct.   The figures are correct and I do owe them a sum as well as 1st payment on account for 20-21. I just am not sure I can pay the lot by 31/1/2021 because I did not anticipate that the hospital may not be able to pay me on time ( my jan pay). Thats because I did submit my 'timesheet' to the HR on time but they delayed processing it in time for it to be paid by the end of this month. They have said they have asked for an exceptional CHAPS payment to be made but I remain uncertain whether they will pay it into my account by then or not. thats why i wasnt sure if its best to call HMRC and give them the heads up or not.

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

A company called MacKenzie hall have left at least half a dozen messages on my 1571 service since sometime in November.

 

I rarely use my home phone, so I only noticed them yesterday.

 

I looked up the number, and the company, and they look to be a debt recovery company.

 

I signed up for a 30 day trial of the credit reference agencies, and can see that MacKenzie hall have made a trace search on me!

 

I do have debts (who doesn't) but they are managed, and all in good shape - the reference agency information all appears correct with nothing untowards showing.

 

So, this morning I phoned the number left by MacKenzie Hall, and after telling me that calls would be monitored, then conversation went like this:-

 

MH: Do you have a reference number starting with M?

Me: No

MH: Have you received a letter in the post?

Me: No

MH: Have you received a telephone call?

Me: Yes

MH: What is the phone number?

Me:

MH: And your name?

Me:

MH: And the first line of your address and post code?

Me: Er - you tell me - I don't know who you are, and I don't want to give you that information because you could be anybody

MH: Well we need to confirm that we are speaking to the correct person

Me: Well I don't know who YOU are, so I want you to confirm yourselves

MH: Then we end the call here.

 

And that was it! Am I in the wrong here? I honestly don't know what they want to speak to me about, but surely, if a compnay is wanting to speak to me about something personal, should they not have to pass some form of check as well? I'm not comfortable just dishing out my information...

Never speak to a dca by phone and never do the security check.

Tell mucky hall 'In writing only' you could send them telephone harassment letter or a prove it letter if they state you owe them money.

 

I've asked BT to remove the 1571 service (since MH are the only people to leave me messages anyway), and I guess I'll reply to MH IF they ever write to me.

You could also ask bt for a new number if thats viable as muckyhall will continue to ring.

Your number could be changed for free, i had problems with dcas ringing my number ( not for me for previous tenants) so i called bt and had my number changed for free.

If you receive a letter from MH please dont ring them, either ignore the letter or if you do reply send a prove it letter.
