    • Tell the friend that the Bank may be able to sell the house, after repossession is granted and could sell it for a much reduced price. Your friend could stand to lose hundreds of thousands of pounds.   Why does your friend not borrow the money or sell goods to raise the money ? Are there goods in the house, such as furniture, that could be sold to raise money ?
    • I haven't checked with the Land Registry but assume the charge is still there.   I have no knowledge of SB rulings but read:   For most types of debt in England, Wales and Northern Ireland, the limitation period is six years. This applies to most common debt types such as credit or store cards, personal loans, gas or electric arrears, council tax arrears, benefit overpayments, payday loans, rent arrears, catalogues or overdrafts. There are some exceptions though: Mortgage shortfalls have a longer limitation period of twelve years for the money you borrowed (the ‘capital’), while the interest charged on this has a limitation period of six years
    • This situation has reared its head again Friend had such luck (through my efforts) at the start of the year to get the bank to clear the service charge debts and add them to the mortgage. Friend ended up having a slightly larger mortgage but at really low interest rate. And the freeholder got their service charge money.   But friend has had head in sand all year.  And has now failed to pay the bank one payment all year!!  It is so infuriating.    With costs, friend now owes apx £1500.   So the bank re-opened the original claim of the freeholders - which they paid off - and have now got a Judgment against friend.  With a repossession hearing in a few weeks.... The value is apx £1.5m.   The mortgage is like £100k.   (About £100/m).   Now Judgment for owing £1500 on a £1.5m property.   I have been telling friend all year to make payments.  Now friend really needs to make a payment.   Still absent overseas.   Additionally - another set of service charges are due now   I won't let these people take the property - but I don't know how to help.   I told friend to pay the mortgage and ask the bank to pay the service charges again.  And in the meantime find a better solution - such as selling an asset.  But nothing has been done at all in the last 9 months.   Any good suggestions?

A company called MacKenzie hall have left at least half a dozen messages on my 1571 service since sometime in November.

 

I rarely use my home phone, so I only noticed them yesterday.

 

I looked up the number, and the company, and they look to be a debt recovery company.

 

I signed up for a 30 day trial of the credit reference agencies, and can see that MacKenzie hall have made a trace search on me!

 

I do have debts (who doesn't) but they are managed, and all in good shape - the reference agency information all appears correct with nothing untowards showing.

 

So, this morning I phoned the number left by MacKenzie Hall, and after telling me that calls would be monitored, then conversation went like this:-

 

MH: Do you have a reference number starting with M?

Me: No

MH: Have you received a letter in the post?

Me: No

MH: Have you received a telephone call?

Me: Yes

MH: What is the phone number?

Me:

MH: And your name?

Me:

MH: And the first line of your address and post code?

Me: Er - you tell me - I don't know who you are, and I don't want to give you that information because you could be anybody

MH: Well we need to confirm that we are speaking to the correct person

Me: Well I don't know who YOU are, so I want you to confirm yourselves

MH: Then we end the call here.

 

And that was it! Am I in the wrong here? I honestly don't know what they want to speak to me about, but surely, if a compnay is wanting to speak to me about something personal, should they not have to pass some form of check as well? I'm not comfortable just dishing out my information...

Never speak to a dca by phone and never do the security check.

Tell mucky hall 'In writing only' you could send them telephone harassment letter or a prove it letter if they state you owe them money.

I've asked BT to remove the 1571 service (since MH are the only people to leave me messages anyway), and I guess I'll reply to MH IF they ever write to me.

You could also ask bt for a new number if thats viable as muckyhall will continue to ring.

Your number could be changed for free, i had problems with dcas ringing my number ( not for me for previous tenants) so i called bt and had my number changed for free.

If you receive a letter from MH please dont ring them, either ignore the letter or if you do reply send a prove it letter.
