      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have received the following response from citibank to my initial letter. I now want to send the LBA but do I need to word it differently to respond to their points? Or do I just send the letter as it is?

 

'Thank you for your recent correspondence regarding fees charged to your current account for overdraft, guaranteed cheque and direct debit transactions.

 

As you may be aware, there is a current consultative fact-finding initiative being jointly undertaken by the British Bankers's Association and the Office of Fair Trading. The purposed of this consultation is to gather information about the prevailing industry practices related to overdraft accounts and the fees that banks charge to process certain transactions.

 

The initiative is still ongoing, and no conclusions have been reached as to the results of the consultation. Citibank is a member of the British Bankers Association and, like other member banks, is providing information in order to assist in the fact-finding.

 

Currently, all charges related to your current account and the associated overdraft facilities are made in accordance with the terms and conditions that you accepted when you opened the account. The rates and charges are provided to customers whenever there is a change. Our investigation of your inquiry shows that all charges to your account were made in accordance with the terms and conditions that you accepted, and consequently no adjustment to your account is warranted.

 

We hope this has gone some way to restoring your faith in our services however, if you feel the outcome is not to your satisfaction, please refer your complaint to the Financial Ombudsman Service, at the address below:

no it is not to do with citicards, it is actually a current account with citibank uk,

the guy is called James Bell, from the customer care unit. I have seen all the citicards emails regarding the stuff from the hapless Mr Smith (who I am not sure exists)

Just going to send the lba tomorrow special delivery and then read up again on the court stuff as I am taking this all the way.

Mr Smith i think does or does not exsist, all the defences i have read on here and any court documents are signed by a David Travis.

I have checked with the law society and Brian Smith does indeed exist as a qualified solicitor - registered at Citis Salford address.

I now have a further letter from Citibank replying to my LBA from me old mate James Bell (no relation to Colin I hope being a blue and all that!) in the customer care unit (a misnomer surely) and I quote:

 

' Further to your recent letter dated 16th October (my lba) I write with regards to your request to have charges refunded to your account totalling £xxxx.

 

I refer you to the letter I sent to you dated 11 October 2006 (I have enclosed a copy in case on (sic) non-receipt). Our decision to not refund any of the charges stands, this is due to the charges being in accordance with the terms & conditions with which you are bound by. (Aye I don't mind charges matey what I do mind is that those charges are clearly above and beyond what is costs Citibank to service my breaches, NB Citibank don't even send out letters!):lol:

 

If you have any further correspondence regarding this matter please send them directly to myself:

 

xxxx

 

If you remain dissatisfied with my response you do reserve the right to make a complaint to the FOS. The details are provided in my earlier letter.

 

I am now going to file to go to court. I am more than happy to see Citibank in court and have them tell me exactly how much their charges really are particularly as they don't even send out letters and so can't even claim postage! I have been watching the citicards cases closely but still can't see anyone on the site who has done this with citibank or am I being dense?icon6.gif

I know some people are doing this for citicards and there has been varying degrees of success but no-one seems to have posted re the bank. I know it is all basically one company but they do seem to handle stuff differently.

It would really help me if someone who has a citibank account can let me know how they went on. I am going to file a court application now as they have responded negatively to my LBA.

There has been a few on citicards - not the bank as far as I know - butthe prnciple is the same and the support you will receive is the same. File your claim and everyone on here will help - particurly if you get Brain - oops sorry I meant brian.

Right I have just been having a discussion with the other Mods and we are concerned about the contents of the latest AQs from Citi defence.

Their requests to have both the hearings at Salford as well as the meetings in private with the Judge should be vigourously contested.A letter to address this is currently being drawn up and will be made available soon.

You should make the court aware of your concerns so that these requestd are not directed.More on this soon.

Please can the mods change the title of my thread and put Greendeco V Citibank, also can someone please let me have the interest spreadsheet as I need it to do my interest as I am waiting to do my money claim online.

 

Have been catching up with the threads and It is more gripping than the new Bond film what has being going on! I think if it is true that some employees of the banks are going on the site and trying to sow discord and to put people off by being negative, then that is very sad. :evil:

 

I agree with one of the posts (Marcopolo?) who said that we have all suffered for many years paying these exorbitant charges. I don't mind paying bank charges, what I do mind is paying £25 when I don't get a letter or even a phone call to tell me there is a problem. What is the £25 for then? I can't wait to go to court and find out. :grin:

 

These banks have been making phenomenal profits for years out of the misery of their supposed 'valued' customers. I would have more respect for them if they admitted their charges are unreasonable and just refunded the money, rather than trying every dirty trick and delaying tactic in the book. Ok sermon over, interest spreadsheet anyone?icon11.gif

Am reading this thread with much interest as I am in much the same position.

 

Have had 2 letters from Mr Bell - actually, the first one got "lost" in the post and was re-sent with the second letter. Have just submitted the Court claim (just 5 mins ago) having paid £120 and am now waiting to see what happens.

 

Good luck with your claim Greendeco and keep us updated with your progress!

I started my claim online.... the 14 days went by..... entered a judgement via the site and then 2 days later citibank acknowledged.... they are going to defend now.... they have a further 14 days to do this....

The bold Mr Smith does exist and along with David Roy Travis is a registered solicitor at Citi, incidentally 3 solicitors are registered at Citi. Who is the 3rd person?

Does anyone know when this case in the Mercantile Court to which they are referring is due to be heard? I assume it isnt v Citi anyway? they are just riding on the back of someone elses costs risks

My claim against Citibank has been transferred to my local court in Reading. I presume that Citibank cannot now get it changed to Salford?

 

By the way their defense letter was signed by a 'Helena Forsgardh Alstrup, Lawyer for the Defendant' Strewth...
