    • ive already CAREFULLY explained how it all works earlier. what you will have to pay is already preset and detailed on the court forms/TfL stuff you already have. you wont be asked any questions upon your financial means etc. thats not under debate . you wont be asked upon any mitigating circumstances, you have pleaded guity which you always SHOULD.  the ONLY 2 reasons you are attending is to: 1) after finding the TfL prosecutor... plead directly face to face before you go in to try and get an OOC (you can bring up or say anything/everything you like ...anything that might get them to agree) 2) if 1 fails...show your genuine remorse face to face to the magistrate, BRIEFLY mention how a criminal record would hinder your future then hope they take pity on you and dont also record this on your file.  PS its only declarable/shows there for one year anyway. regardless to what an employer might ask in job questionnaires past 1yrs you forget about it. they cannot see it even on enhanced DBS etc etc. you should not latterly ever appeal a criminal record for this type (1yrs)  of 'offence' its not worth it and if you lose said appeal it will cost your dear in terms of additional wages grabbing and court fees. and extends the time it shows if you lose too. dx

I was very sorry to learn that you recently received a parking charge notice after shopping at our Kearsley Manchester Rd Express store. I appreciate this is always frustrating, especially as you'd just nipped in for the one item. I've had a look, and I can confirm that in this case the car park at this store is entirely owned by a third party - it is not owned or operated by Tesco in any way. The parking charge issued is on behalf of that third party, although I appreciate it does state Tesco on the letter. Regrettably as the car park is owned and operated by a separate company we don't have any form of influence or control over the parking charges issued. In this case, I can only recommend that you follow the appeals process outlined on the letter directly to take the matter up with UKPPO directly.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I came out of the army in may 2009 due to a knee injury,

all is fine now im back to full health,

 

in the meantime I decided to sign on because i only thought it would be 6-8 months till I'd be back in the army.

 

I ve had 2 sanctions before for missing work programme even though no letter was sent out telling me when and where it was????!!!!

 

Since then i have had no problems until last week,

i signed on as normal my entire job search was filled in i look for any job to tie me over until i can go back to the army.

 

From the start this woman's attitude was rotten!!

I havnt been in work for 3 years because of all the problems with my knee i didn't want to claim disabilty or sickness

because that will haunt you the rest of your days the way people on benefits get scapegoated these days,

an it was just an injury i wasn't incapable!!

 

She looked at my job search which every section was filled in!!

She found one job at toys r us and asked me if i applied for it i said yes,

she then said if she was to call them would they have my form i said yes,

 

she then said i dont think this is true im putting you up for sanction i don't believe you have been doing enough!!

 

my entire job search was filled in i sign on on time and i go to every course they send me too an this is still not enough!!!!

 

I felt it was a personnel attack as ive never been spoken to like that in the jobcenter this woman just seemed irate and very unprofessional and rude.

 

Im very very very stressed about this as it a couple of weeks before Christmas

i already get underpaid on my housing benefit which i have to top up form out my job seekers which im now not getting,

i have no food an no one i can turn to for finacial help. I

 

m pointing out now that im not a scrounger i actually go back into the army in January 2013 so at least im lucky to be getting my old job back,

I could completely understand if a person didnt do a job search or didnt go to a course ect ect but i apply for 10 to 15 jobs a week

and go to there work program how is this justified and how is it going to benefit the country in the long run,

 

im kinda lucky to have a job to start but those who dont i really feel for and i can see crime rates going through the roof if this carries on!!!

 

does anybody have any advice or been down the same road??

 

i have 3 job interview next week and have to swear in at my local armed forces office i know cannot get there as i have no money

so bassicly this system is keeping me unemployed im at my wits end even people who are sorting thier lives out are being punished this is wrong!!!!

Simple rule when attending Work Programme or JSA is to take a recording device with you and record these idiots.

When you get these people acting out you have evidence of their attitude or behavior to you and can make a formal complaint against them.

The Gov are no longer interested in getting the unemployed back into work, They can now sanction anyone for what ever reason, The result is the

same, another person off the unemployed list/numbers.

Looking back i wish i did!!!

 

Went to appeal today got told if i filled in another form i can get hardship at the end of today (which turned out to be a load of [naughty word])

they obviously say these thiings to keep you sweet an get you out......

 

..... Im at my wits end tbh i see achloholics and drug addicts never go without im 4 weeks away from going back to the army an the systme has put a giant spanner in the works,

if i didnt have a job lined up id have to go back to crime people need to eat!!!!!

 

How is this system justified and "helping" poeple in any other country this would be against human rights seems to me the worst to be in england is english

somtimes i wonder why im signing up to fight for this country again!!!!!

Can I suggest, to lose the negative, crap, your getting from JC+

 

How about pop into your bank, and ask for an overdraft??

 

You go back into the forces, in january. I guess you must have paperwork to prove this.

 

Get some help from the bank, and [EDIT] the JC+

 

This advise would'nt help, most. But you are in fact, in a fortunate position.

I know, your feeling pretty aggreived..... and why not!

 

Just thought this would help improve, your sense, of wellbeing

I dont let it drag me down its just very annoying im very close to getting off this system they can make it as hard as they want im still going to get off it, I just dont think sanctions are justified.

 

I dont have the paperwork for the army as of yet but my recruiter has promised me january intake just lit waiting for my doctor to tick a box an my start date will get released :)

 

unfourtunetly because i have no proof of income i cannot get a overdraft on my account plus i have 2 huge payday loan debts above my head for the last 2 times they put me on a sanction :/

 

apart from that im positivve just worn out from all the stress of loosing money getting behind on rent its the same thing but over and over again im a headstrong fit and healthy positive person but even this is grinding me down, as you say i have 4 weeks of this **** left an im out of here just cant see how these sanctions are helping in any way all it does is pile more stress an worry on you feel for the poeple who are stuck in this situation!!!!!!! Another reason why i think posh eaton educated bellends should not be running the country!!!! I fell david cameron ha scapegoated anyone on benifits to the point that even employers thing jsa is for spongers and scroungers so in turn they wont take on many people at all from the job center

I have been asked to take a look at your problem, must say I very much admire your attitude and courage in this situation!!

 

Let's look at the JSA scenario, I think you should contact TOYs r US and get written confirmation that they have received your application, this arrogant ''clerk'' should have contacted them immediately after she had stated she did not believe you, taking such punitive action without justification is dereliction of duty and a failure to exercise due diligence and a complaint to the JC+ MANAGEMENT is required asap.

 

Why not contact the RBL and or SAFA, you are eligible for help in this situation IT IS NOT SCROUNGEING in any way, you are committed to serve again in January

so don't hesitate, regimental welfare may also be more than willing to help here.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

The point is he should NOT be forced to borrow just to live.

You are giving me and idea but that would raise two questions:

 

1) Is it legal to record a conversation without informing the "victim"? Would he/she or the DWP then sue for breach of privacy?

 

2) I have a mp3 player that acts also as a recording device. How big the size of the file when recording a 10 min conversation? Nobody uses tapes anymore...

Depends on the quality of the recording, but generally speaking, a full CD album is about 45-60 MB for what, 8-10 x 3mns songs? An .avi file for a movie is about 700MBs and that's for 1.5 hours of sound AND video! As long as your mp3 player is relatively recent, it should have at least 1GB of memory so you should be fine. Best thing is to test it at home, record yourself talking for 10 mns and see how that works out in data size!
