unfair dismissal need help for ET1

Dear All

 

Last Month I was dismissed. I knew since a year this this will happen. I joined this big company more than 4 years ago, my role is quite technical as i am dealing with regulatory compliance...

 

before going on maternity leave i complained against my manager. when i came back, the person who covered my maternity leave became my boss. quite rapidly i had to go through a performance improvement project...the phase I lasted 2 weeks and i received a warning. the second phase lasted 8 weeks...and i have been fired...i had to wrote 3 reports on 3 objectives for which i knew 8 weeks were far away from sufficient...

 

I was not allowed to go on holidays, noone questionned my expertise even they dare say that my knowledge on legislation was impresssive but as i did not engage with key people (.this based mainly on feedback.) and as my reports were below expectations, i was fired.

 

I put grievance against my managers: the first one I complained about some behaviours: i have been excluded from eetings discussions since I am back from maternity leave, my manager had distord facts to put me down. I had also proof that my new manager was not that expert and had made a lot of mistakes...

 

so i asked them how he was able to assess my work and decides that 8 weeks were enought if he was not that clear about what to do?? I had problem with a team which refused to follow the legislation...and after a year nothing happened. It was said that it was my fault even, my manager asked me to do nothing...i escalated problems and a grievance was raised ...but no psotive outcome...my manager was perfect, he made mistakes but improved his skills etc..

 

I asked in my grievance the proof that my managers were very good in communication so that I can learn, and if it was the case they should have influenced the team i struggled with!!

 

I complained about the lack of support, and also the fact that HR were not including my comments in the minutes meeting, these minutes meeting were used for the dismissal...

 

in my work i told them that 2 weeks were too short to engage with senior managers...discuss what needs to be done and take actions...with my day to day activity, plus it was impossible to engage with key people when they receive opposite recommendation from my manager...or when these colleagues were waiting for the green light from my manager and this one kept silent..

 

at the end it was impossible to progress for these reasons plus the company is going trough a restructuration, so nobody knows yet what their team will do...therefore noone wants to move before we have a clear view on the new organisation...

 

i did complain about the constant critics, and if he was os bad in communication why i received no training?

 

i have been off sick for stress ( i have heart problem too) and they did not allow me to go on holidays during the summer and my family is abroad, I am on my own here.

 

I am waiting for the dismissal appeal meeting before sending my ET1

i have been dismissed a month ago!! they wanted me to attend the grievance appeal meeting even i was convinced it was a waste of time. ..

this is so stressfull... i am convinced now that the tribunal will be on their side...

Hello and welcome to CAG, I'm sorry you're having a tough time.

 

I hope the guys will be along later with help for you. I believe an ET1 needs to be key points rather than the whole story, but the guys will tell you.

 

Are you keeping any written evidence that you have, including emails etc? But if you're in compliance, you probably know about paper trails...

why is the dismissal appeal hearing taking so long

 

remember you have three months less one day to put a claim into the tribunal service from dismissal date

 

it has been know for employers to try and pass this three month stage to stop an appeal to the tribunal service before holding the appeal meeting

 

you can put in a claim to the tribunal service at any time, you do not have to waite on any grievance or appeal process to be concluded by your company before instigating the claim.

 

you can withdraw a claim to the employment tribunal service at any time

hello

 

they first wanted me to attend the grievance appeal hearing, I refused and asked them to send me the document. the grievance hearing was a joke: the person read a document...and she told me that none of my complaints were relevant..

an example: the person who covered my maternity leave was allowed to work form home once a week. i was not..

they told me that my role requires my presence at the office. my manager dare asking me if when i wanted to work from home, if i will have my duaghter with me... he is working from home, he has two young children who are not going to nursery...

this is unacceptable... a number of people can work from home on a weekly basis..

 

in my grievance I also said that i was not allowed to go to worshoips I used to go in the past...which were useful...

eveything i asked was refused...it was for me harassment..they say no..it is suddenly normal...in that case my role has changed without me knowing...it is important ot attend workshop in order to follow progress changes in regulation...why suddenly i cannot go nowhere..

hello since while i keep evidence

 

in the grievance i added in annex all prooves , the main one was the team which refused to follow the "law" , i had their position full of mistakes and erroneous interpretation of legal text....

i was fired as my work did not met their standards. I asked them if those people much more senior than me, were representing the company standards??? mistakes but concicely presented. i wrote a long detailed report as my boss wanted to know everyhting i have done since i joined the group...in my report i demonstrated that we were far away from being compliant and in case of control we were at risks...we needed more resources etc....100 pages document. the main comment: you failed!!
