      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone,

 

Got my myself into some mess with payday lenders, called RBS a month or 2 back to ask them to stop authorizing these payments as i am disputing the loans with the lenders, but they've still carried on, even though i don't have an overdraft i'm now -£46, which isn't loads but as i'm now claiming job seekers allowance this will barely cover that.

 

RBS allowed 3 payments to be taken from my account on Friday 30th November totalling £135 (£60, £37.90, £37.90), so now i have no money i've got to find a way to live without food for the next 2 weeks.

 

These banks and loans sharks shoot themselves in the foot, if i've got money to pay them what i owe i will but when i have to borrow money elsewhere to survive these lot are the last of my worries.

 

Any help please, i've got a visa debit card and was told i can charge back the money is it possible?

First and foremost you need to get yourself down the bank and tell them you want to cancel the Continuous Payment Authority. Regardless what the bank says they should do this. Then you want to tell them that these payments are in dispute and you want them reversed as well as any charges they may levy for you going into a unauthorised overdraft limit.

 

Also remember the bank cannot take your JSA to pay for any bank charges you may incur

Thanks, unfortunately my nearest RBS is 13 miles away and i can't get there so my only option is to call them or send them letters.

 

Checked my bank this morning to see two more payments have come out which puts my down to -£104. Called the chargeback team they said they will do nothing, they can't cancel the recurring payments as they are debit card transactions, even though two weeks before i wanted to cancel my card and they said there is no point as the card has a guarantee that they can take payments.

 

What i'm trying to get my head around is the fact they declined some of the debit card attempts but allowed the rest.

 

Seriously the worst bank on the market, they're thieves that are some how still allowed to do this sort of thing to anyone they please.

Called them again today, now -£104, and i said so you're not going to do anything to help me and they basically said no because "they can't do anything". I'm not going to report them to the oft or the fos as they don't do diddly squat, i need my money now not in 6 months time, maybe none of us should report them or make complaints because it hasn't made any difference?

That is all total bull****, they can cancel the continuous payment authority, you need to request that they do exactly that.

 

Ring up, make sure you take the persons name first.....

 

CANCEL THE CONTINUOUS PAYMENT AUTHORITY.

 

If not tell them you will take them to the FSA after you have made a complaint via the banks greivance procedure first

I would look at telling them they have broken the 2009 Payment Services Directive and you would like this money back as it should have not gone out when you had already directed them not to take it.

 

Also mention the fact you are on JSA and have nothing now for a couple of weeks.

RBS are one of the worse - you do need to be firm with them. They MUST cancel the payment on your instructions.

Also might be wise to setup a parachute account in the interim and get any benefit paid into that until such time you get this sorted

 

Yes, you must set up a parachute account with either the Co-op or the Post office, whilst this gets sorted - otherwise they will simply continue to drain your account.

You need to open a parachute a/c with the Cooperative bank or Post Office whilst this gets sorted otherwise they'll just keep getting money taken as soon as any comes into the a/c.

 

You can open a COOP a/c http://www.co-operativebank.co.uk/servlet/Satellite/1193206368743,CFSweb/Page/Bank-CurrentAccounts by 'phoning 0845 602 7057. It's better to 'phone rather than going into a branch because a lot of the front of house staff are unaware of cashminder a/cs + you don't have to make a deposit to open it.

 

It doesn't matter if you don't have a branch near you either as you can use any post office.

it is known as a ‘recurring transaction’ or ‘continuous payment authority’.

These are often confused with direct debits, but do not offer the same guarantee if the amount or date of the payment changes.

In most cases, regular payments can be cancelled by telling the company taking the payments.

you have the right to cancel them directly with your bank or card issuer by telling it that you have stopped permission for the payments.

Your bank or card issuer must then stop them – it has no right to insist that you agree this first with the company taking the payments.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
