Santander have refused to pay PPI

Hi! I'm new to all this. :!:

 

I have received a reply from Santander regarding PPI paid on a Debenhams account.

 

They are refusing to refund the PPI payments.

 

They have enclosed a copy of the account application dated Feb 2002 showing my signature at the "Protect Your Account" section.

 

The shop assistant did not discuss PPI with me at the time and it clearly shows that she has marked "X" where she wanted me to complete the form and where she wanted me to sign.

 

It's the usual story that we are all so familiar with now "If you open an account today you will get 20% off your purchases". No mention of anything else.

 

They also state that this is their final response and they have now reached the end of their internal complaint handling procedures.

 

They have advised me that they are members of the Finance & Leasing Association and thay may also be able to consider my complaint.

 

Any suggestions what I should do now????:|

I advised them that both my husband and I have been in full time employment since I opened the account;

we have never been unemployed;

we would be able to pay bills if one of were to become unemployed and we are paid when we are off sick.

 

I advised them that I niether required nor wanted PPI and would have refused it if I had been asked if I wanted it.

Ok so you appear to have valid reasons for a mis-sale

 

1 Someone else apparently selected it for you and tehn just handed the form for you to sign with the PPI box pre-ticked?

 

2 You had adequate means to pay the account therefore did not need insurance

 

3 You had adequate sick-pay provisions

 

4 You would have refused it if it had been mentioned.

 

 

Sounds to me like you have been given a standard fob-off.

 

You are entitled to write back to them and challenge their findings one by one putting strong emphasis on your points.

 

This one may be outside the jurisdiction of fos but it may be worth giving them a call to find out whether they would take it on or not.

 

Failing fos, and of you don't get a satisfactory respomns to your challenge with the lender then the FLA would be the next step and get them to look into your complaint.

the sales rep got a healthy commission for selling the PPI.

Thanks for all your help! Sounds like good advice to me. I was thinking of contacting FLA and FOS.

 

I've had a similar response from next.

I have sent them a SAR to obtain my paperwork.

 

Slightly different story from Next.

" It was those bad boys (First Assist Insurance Services Limited) over there and then they ran away". LOL!!!

 

Next state they are not subject to the jurisdiction of FOS though?????

I will need to look into the Insurance company.

 

To make it even more frustrating I got a letter from Next late 2010 advising me that they were going to stop the PPI

and that if I wanted it to continue I would need to get in touch with them.

 

Naturally I didn't get back in touch as I did not require this insurance.

 

They also advised me that it would not affect any claims I might have?????

 

Unfortunately, I no longer have the letter.
